Kylie Grimes, was 18 when her friend, Katie Hawkins, invited her to join a group going for a midnight swim in the pool at her father's house in Surrey on August 5 2006.

A teenager who was paralysed after diving into a swimming pool during a party at a former friend's home is suing the girl's family in a multi-million pound damages suit because there were no warning signs.

Miss Grimes is suing David Hawkins, 54, her former friend's father who is a director of a forklift truck business

Miss Grimes accepted the invitation but suffered terrible head and neck injuries when she dived into the pool and struck her skull on the bottom.

She was taken to hospital where she received treatment but doctors were unable to counter the effects of her injuries and she was left tetraplegic. She can now only move with the aid of a specialised wheelchair.

Miss Grimes is suing David Hawkins, 54, her former friend's father who is a director of a forklift truck business. She is also suing the managers of the trust which runs Frimley Park Hospital, where she was treated after the accident.

Prior to a preliminary hearing at the High Court, and speaking outside court, James Burton, for Mr Hawkins, said Miss Grimes' case against Mr Hawkins was based on allegations that there was inadequate signage around the pool at his home, stating that guests should not dive, or indicating the depth of the water.

Mr Burton added that Mr Hawkins had not been present in the house in Farnham, Surrey, when the accident happened.

He went on to say that Miss Grimes is also bringing an action against Frimley Park Hospital NHS Foundation Trust, on the basis that the treatment she received was negligent and contributed to her ongoing severe disabilities.

Describing the tragic case as a "no win situation", Mr Burton added: "It's not good for anyone - If Miss Grimes wins her case then the homeowner will be made bankrupt. But if she loses, then she gets nothing."

My daughter dived off the dock up at the lake house in Pa. where the water was only about 3 feet deep. Thankfull she only needed a few stiches in her lip and knocked her tooth loose. We immediately painted "Shallow Water, No Diving" on the end of the dock.

She was an adult and this wasnt a hidden hazard. Her fault.

Even if there was a sign, would she have seen it at midnight?




FWIW I've never seen a sign posted at a personal pool ...at a party after midnight, I'm not sure I could have read one if there were.

I have an above ground pool that is 4feet deep. I have stickers on the railing and on the ladder saying No Diving. And wouldn't there be lights on during a party?
