A high school senior in Florida is reportedly threatening legal action against her school after she didn’t make the varsity cheer squad.

The student was denied a spot on the squad at Leon High School in Tallahassee after an open tryout in front of multiple coaches, the Tallahassee Democrat reported.

Head cheer coach Caylen Berry, whose team was the runner-up at the state championship last year, told the newspaper the girl fell twice during her tumbling tryout.

The mistakes gave her a score too low to make the varsity squad, and she is not eligible to make the JV squad because she is a senior, Berry said.

The complaint prompted the high school to look into the issue, district spokesman Chris Petley told BuzzFeed News.

“The leadership of Leon High is continuing to review the issue and in the coming weeks will provide an update as needed to those involved,” he said.

He added that the student has yet to take any legal action against the school, and he hasn’t been able to confirm that a lawsuit was threatened.

Berry said she may quit if her decision is overruled by the school.

“They should not put an athlete on the team that doesn’t deserve to be on the team,” she told the Tallahassee Democrat. “A decision like this would question my integrity as a professional. It also questions the entire legitimacy of tryouts and cheerleading as a sport.”

The coach also claimed that similar issues have occurred at other schools in the district in years past, and students who initially were cut were placed on the squad.

“This is just a thing the district does and thinks is okay,” Berry told the Tallahassee Democrat. “I don’t know why the district feels the need to go behind the back of the coaches and the school.”

So, no one has sued, or even threatened to sue, or retained an attorney, or even articulated some actual basis for bringing any type of legal claim. All there has been was some kind of "complaint" made to school officials about the cheerleading tryouts that has "prompted the high school to look into the issue." But this is now being spun into another myth about our "sue-happy" society.

And of course everyone now has to bash the civil justice system and "frivolous lawsuits," because "everyone knows" that all you have to do is say the magic words and people throw money at you, etc. etc. etc. :roll: :roll: :roll:

Well, don't they? ;) :mrgreen:

It's gotten to be almost like the opening moves of a chess match.  Player 1 opens by threatening a lawsuit; player 2 denies responsibility/liability.  Player 1 actually files the lawsuit.  Player 2 dummies up and makes a statement about how "they cannot comment on pending litigation".  Player 1 presses by going public; player 2 counters by asking how much it would take to make this all go away.  And then the rest is just endgame.

I mean, it's so much the expected way things go nowadays that it was considered to be newsworthy when the parents of the toddler who was taken by the 'gator at Disney World decided that they were *NOT* going to sue the Disney Corporation.

There have been many lawsuits regarding getting playing time for a child. Cases obviously range from having a legitimate beef to being upset at the family's precious flower not getting his/her due. Hard to know how these turn out because the news is in reporting the story, not following up on how the case came out.
