An Islamic faith school's policy of segregating boys and girls is unlawful sex discrimination, a court has ruled.

The case was heard at the Court of Appeal as Ofsted challenged a High Court ruling clearing the Al-Hijrah school in Birmingham of discrimination.

Ofsted's lawyers argued the segregation left girls "unprepared for life in modern Britain".

Appeal judges ruled the school was discriminating against its pupils contrary to the Equality Act.

However, the court did not accept the argument the school's policy had disadvantaged girls more than boys.

The appeal judges also made it clear the government and Ofsted had failed to identify the problem earlier and other schools operating similarly should be given time "to put their houses in order".

About 20 schools - Islamic, Jewish and Christian - are thought to have similar segregation policies.

Ok, not for nothing, but how many sex segregated schools are there in the UK, particularly in England? It's got to be a hell of a lot more than the 20 religious schools they have singled out here, and of course it was the norm for hundreds of years. But it never bothered this guy until he heard about an Islamic school doing it...

I would have thought that if anything was likely to leave girls "unprepared for life in modern Britain" it would be the school-age religious segregation, not the gender segregation.

I may have misunderstood, but the point isn't single sex schools, is it? I read these are schools that provided classes to both genders (note: there are only two) but segregate them, providing perhaps different curricula - another version of "separate but (un)equal"

There's nothing inherently wrong with private schools that cater only to one gender. So far, anyway.

AFAIK, Dover Grammar School for Boys is doing just fine, as is Dover Grammar School for Girls. Mind, the girls do have snooty house names: Stephen de Pencester, Queen Ethelburga, St Martin, Hubert de Burgh. We DGSB lads had the eminently brief and sensible houses of Frith (the best one), Park, Astor and Priory.
