Three Derby men have been jailed for giving out leaflets calling for homosexual people to be executed.

Ihjaz Ali, Kabir Ahmed and Razwan Javed were found guilty at Derby Crown Court last month, of stirring up hatred on the grounds of sexual orientation.

The leaflet, titled Death Penalty?, was distributed in the build-up to a gay pride event, in July 2010.

Ali was jailed for two years while Ahmed and Javed were given 15-month sentences.

It is the first prosecution of its kind since new laws came into force in 2010.

The leaflets, which were handed out and put through letterboxes near Derby's Jamia Mosque, were described in court as "threatening and nasty".

They showed an image of a wooden mannequin hanging from a noose, quoted Islamic texts and said capital punishment was the only way to rid society of homosexuality.



Two other leaflets, called Turn or Burn and God Abhors You, were also distributed while a fourth, called Dead Derby, was found but not given out.

A Christian street preacher was yesterday cleared of harassing a gay couple - after telling them homosexuals would 'burn in hell'.

Religious Michael Overd, 47, was accused of using threatening or abusive language against Craig Manning and Craig Nichol as he preached last July. A court heard that he approached the pair in busy Taunton High Street, Somerset, calling them ‘sinners’ and proclaiming they would ‘burn in hell’. But Overd claimed he was merely exercising his right to expression by reading from the bible and was acquitted of the charge by Taunton Deane Magistrates yesterday. Dean Lampard, from the Crown Prosecution Service (CPS), speaking after the verdict, said: 'We take allegations of this nature very seriously and when we reviewed the case we determined it was appropriate to charge Mr Overd with harassment. 'We examined the evidence and were satisfied that there was a realistic prospect of conviction and that it was in the public interest to bring criminal proceedings. 'We respect the magistrates’ decision today. 'Everyone has the right to live their life free from harassment and distress and we will continue to work closely with Avon and Somerset Constabulary to investigate any allegations of hate crime of any sort, be it homophobic, racist, religious or disability hate crime.'

I find it rather amusing (no, actually quite sad) that some "Christians" seem to zero in on homosexuality when there are so many other sins to focus on.

It is my belief that people who do this (both Christians and non-Christians) have their own issues regarding human sexuality.

Obviously what these people are expressing is vile and disgusting. And as I said in the case of somebody punching out a flag burner, if I saw someone cold cock one of these assholes, if the cops came up to me and asked me what I saw, I'd make a really poor witness; I'm sure I would have been looking in a different direction at the time...

But in this country, we don't have laws like this; and I'm glad we don't.

Once you have laws against "stirring up hatred" you put government in the business of determining what constitutes "hate speech" and then empowering it to punish those that engage in that speech. I don't want government in that business. I don't want government in the business of determining which opinions are acceptable and which are not, and I certainly do not want it to have the power to toss in jail those who express opinions that it deems unacceptable.

In my view, the potential for abuse, and the potential negative implications for society in general that would flow from empowering the state in this way far out weighs having to put up with allowing whack jobs to publicly express hateful and repugnant views. That price is worth paying, to safe guard a freedom which I believe is fundamental to the long term survival of a free society.

Now, as I've said before, this doesn't mean that that I believe that people have a right to express any views they want to , anywhere, any time. I will never be mistaken for a "civil liberties absolutist". I don't believe that Nazis have a "right" to march in uniform past the homes of Holocaust survivors, and I don't believe that the Westboro nut jobs have a "right" to express their view that so and so is burning in hell at so and sos funeral...

But they do have the right to express these odious views publicly, somewhere some time.
