The Voting Rights Act Decision....

Post by Lord Jim »

You would think from the hair on fire hysterical attitude from many on The Left on this, that the Supreme Court had re-established Plessy V Ferguson as the law of the land...

The fact is that over the past couple of years, The Justice Department has used Section 4 of The Voting Rights Act to block at least two states (Texas and Florida) from enacting voter ID laws that have passed Constitutional muster in other states..

Why should a law that is Constitutionally acceptable in Indiana, not be acceptable in Texas?

If the Justice Department is using the Voting Rights Act to prevent targeted States from doing what the Supreme Court has said that other states may do, there's an obvious political factor in play here...

If the Justice Department is using The Voting Rights Act to prevent Texas and Florida from having the same Constitutionally acceptable voter ID laws as Indiana, it is the Justice Department's behavior that should be held as suspect, not Texas' or Florida's...

There remains a legitimate reason for a well structured, intelligent Voting Rights law...

Racism has not come to an end...

But the approach needs to be intelligent and modern, and not reflexive...

*Edited to have the name and section of the law accurate.

This law, like affirmative action laws, was designed to become unconstitutional at some point when no longer justifiable. While Congress had the chance to say that time had come in 2006, the political pressures were such that that was not going to happen. And, of course, that then leaves the targeted states at the mercy of whoever holds the levers at the Justice Department.

Chief "Justice" Roberts had been looking for a way to undermine the Voting Rights Act for decades. "Justice" Scalia has admitted that he believes that the protection of African-American voting rights against the racism of the faux-American South is a "racial entitlement".

The best things that could happen for America would be for Roberts, Scalia, Thomas, and Alito to retire or drop dead and then for Reid to invoke the "nuclear option" so that Obama's four replacement nominees would be rapidly confirmed.
Reason is valuable only when it performs against the wordless physical background of the universe.
