Witnesses in the neighborhood were astonished to see Young driving with the kids - ages eight to 14 - on the outside of the vehicle, and were even more shocked when four of the children were flung from the car after Young took a sharp turn. As the children laid injured in the street, Young kept on driving, apparently unaware that the kids had fallen off the vehicle

You couldn't make this up.

(a) Where did they get the ova? Why is the BIOLOGICAL MOTHER of the children not mentioned in this article?

(b) To say that the woman in whose uterus these two boys resided for nine months (more or less), has "no biological relationship" to the children is beyond ridiculous.

(c) Are the States required to give "Full faith and credit..." to the public acts of the District of Columbia (i.e., not a "State")? I'm sure they are, but it's an interesting question.

(d) This judge is interpreting and applying the law as she sees it. There is nothing outrageous or unsupportable in anything she has done. Interesting that the female attorneys who have posted on the issue are unanimous in their hostility. Apparently they believe that the judge should "do what's right" and then craft an opinion that supports it. Typical liberal attitude - and exactly what is wrong with the American judiciary.

(e) This is an entirely contrived crisis. No one is threatening to take these kids and put them in foster care or deprive them of anything at all. Is there any doubt whatsoever that the twisted machinations that their biological fathers have gone through will be state-sanctioned long before they are old enough to read a Birth Certificate?

(f) "hatred"? Are you shitting me? Get a grip.

(g) I can only imagine the different reaction that a "typical" Southern Baptist Texan would have to this situation: "How selfish and inconsiderate must those [men] be to bring two innocent babies into such a [fouled] up household. God help them."

A few answers:

Where did they get the ova? Why is the BIOLOGICAL MOTHER of the children not mentioned in this article? An egg donor is not the biological mother under the law anymore than a sperm donor is the biological father

(b) To say that the woman in whose uterus these two boys resided for nine months (more or less), has "no biological relationship" to the children is beyond ridiculous. she has no genetic relationship whatsoever; are you devising another basis for motherhood, that of incubation?

(c) Are the States required to give "Full faith and credit..." to the public acts of the District of Columbia (i.e., not a "State")? I'm sure they are, but it's an interesting question. That depends; to court judgments, yes, but not to contractual status. So when interracial marriage was illegal in some states many courts just ignored it and refused any rights of the spouse (such as to inheritance or even a presumption of parenthood). the same sort of thing is happening here

Why do you say that? There is no guarantee Texas will in any way recognize the relationship even when the kids are too old to read a birth certificate, which lead to the ludicrous right of the surrogate, with no genetic relationship to the child, to claim parentage and possibly custody should she choose to do so--after all, only she is on the birth certificates I don't see it as a contrived crisis in any way, it's a real risk the fathers are facing.
