The anti-deportation group said that Gutierrez, who called on Mr Obama to stop all deportations, felt she could not celebrate while transgender detainees were in US Immigration and Customs Enforcement custody.

It depends, if it was a public forum he has to expect being heckled and confronted--that's part of being the leader of a democracy. If it was a private party, then he was right. Granted he wasn't as heavy handed as Christie or even W and his henchmen were, but I didn't see grace; it's more like he was pissed off.

And oldr, would you really be surprised that there are transgender undocumented persons in custody? I can think of many countries where they would be subjected to much more abuse by the government and their fellow citizens than they are here, so I'm sure some have come and been detained. And indeed, some may have even been granted asylum and released, but while sexual orientation is a recognized basis for an asylum claim, it is not as clear with being trnasgender.

And why are we seperating the transgender illegal immigrant froma regular heterosexual illegal immigrant vs a gay/lesbian illegal immigrant vs a bisexual illegal immigrant vs a cross dressing illegal immigrant.
Does it make them any less illegal?
Does being transgender put you at less (or more) chance of being deported?
To me they should all be released from custody, escorted to a bus/plane and taken back to their country of origin with no consideration for their sexual preference/orientation.

The reason sexual orientation could be important is because the US will many times grant asylum to persons who are being persecuted (or at risk of being persecuted) in their country based on a number of things, including sexual orientation. However, transgender and transsexual persons are not specifically included and the immigration courts have split as to whether discrimination/persecution on this basis is sufficient to make an asylum claim. Many are detained pending their hearings and appeals, and many are deported. There is a lobby which is seeking to remedy this and include transgender/transexual persons among those eligible for asylum.
FWIW, granting of asylum is something most countries do to help those unfairly targeted or persecuted for a number of bases, including political opinion, membership in a minority in the country of origin, religion, among other things. Right now I have an application pending for a 17 year old (actually she's 18 now and has his kid) now who was raped by a prominent man in her town, and threatened with commitment to a mental institution when she reported it. If she were to return, it's likely she would be subjected to persecution and violence. IMHO, not everyone should just be shipped back immediately, no questions asked--we're far better than that. Asylum is far from guaranteed, but it is much, much harder to obtain when the person doesn't fall within a statutory group, which is why some are so concerned.
Meade--I'm pretty sure the number is not zero, but if you have information, I'd be happy to see it.
