Utah woman faces possible prison time for trashing pro-police sign

A Utah woman faces hate crime-related charges that could send her to prison for a year after she allegedly stomped on a pro-police sign and smirked in an “intimidating manner” at a deputy who gave her friend a speeding ticket.

The charges stem from an incident that occurred at a gas station in Panguitch, Utah, on July 7, when a Garfield County sheriff’s deputy pulled the suspect’s friend over for speeding.

The suspect, 19, was consoling her friend about the ticket when she allegedly tried to “intimidate” the sheriff’s deputy by destroying a sign that read “Back the Blue,” according to charging documents obtained by the Salt Lake Tribune.

“I observed one of the friends … stomping on a ‘Back the Blue’ sign next to where the traffic stop was conducted, crumple it up in a destructive manner and throw it into a trash can,” the deputy wrote in the charging document obtained by the Daily Beast.

He added that she did all this “while smirking in an intimidating manner toward me.”

The officer did not back down from the “intimidating” smirk, according to the document. Instead, he read the woman her Miranda rights and asked where she got the sign. She initially claimed that she got it from her mom before acknowledging that she found it on the ground, according to the deputy.

The deputy said it looked like a sign issued by his sheriff’s office, so he arrested her for “destroying property that did not belong to her in a manner to attempt to intimidate law enforcement.”

The woman has been charged with disorderly conduct and criminal mischief with a hate crime enhancement, which includes a maximum sentence of a year in jail.

The hate crime enhancement was added because the woman was allegedly trying to “intimidate or terrorize” the officer, the charging document said. “Intimidate or terrorize” means causing a person to fear for their safety or causing damage to the property of that person or another, according to Utah’s hate crime statute for civil rights violations.

The Garfield County Sheriff’s Office and the county attorney’s office have not commented on the sign case.

The suspect has not been identified.

It’s not the first time that someone has faced a hate crime enhancement for vandalizing pro-police signs in the county. Last year, a 32-year-old was charged with a hate crime after he used pink spray-paint to edit a “Back the Blue” sign in Garfield County, so that it read “Back the Bisexual.”

The man ultimately pleaded guilty to a graffiti charge in the case. He spent two days in jail, paid a $500 fine, wrote an apology letter and agreed to 12 months of probation.

“You come into my county and destroy our treasures — whether it’s a bridge, a monument or anything else — you will be arrested and charged,” Garfield County Sheriff Danny Perkins told the St. George News at the time.

Police have faced widespread backlash in the United States and Canada over the last year, dating back to the murder of George Floyd by police officer Derek Chauvin last May. Some conservatives have responded to the Black Lives Matter backlash by rallying around police with slogans such as “Back the Blue” and “Blue Lives Matter.”

The tension between police and activists has boiled over in many places, including Utah, where authorities have used statutes to enhance the potential jail time for anti-police protesters.

Last year, for example, a woman faced life in prison for buying red paint that was later splashed on the Salt Lake County district attorney’s office during a BLM demonstration. Authorities used a gang-related enhancement to increase the potential penalty.

She ultimately agreed to pay $100,000 in damages as part of a plea deal in the case.

Fine.  Next time you've got an emergency situation, call a Trumpanzee or a BLM supporter.

Maybe I should make the statement that guys like Rudy Giuliani or the other legal eagles that keep harping on about how the election was stolen from Trump just proves that ALAS (all lawyers are scheissters) and that Dick the Butcher (in Shakespeare's Henry VI) had the right idea all along.

Police in the U.S have gone to court over and over and over again to claim that they have no duty to protect the citizens who pay them to do precisely that. And over and over and over again, the courts, right up to SCOTUS, have agreed with them. Police have no duty to protect people from harm. Police in Florida had no duty to protect school children from a gunman who was mowing them down like cannon fodder. If police officers were to come across a 12 year old girl being gang raped while a broken bottle was shoved up her anus, they would have no duty to intervene.

So remind, me, Bill, if police have zero duty to protect you and me and anyone else from harm, what the fuck are they good for? Except drawing a fat paycheck and pension?

1st example. The police didn't go to court to prove anything of the kind. The child's mother laid charges against the Department of Social Services. It was a report from the police about child abuse that got the DSS to take action in the first place.

2nd example. Violation of a restraining order by a husband. "However, since she from time to time had allowed Simon to take the children at various hours, the police took no action". "Da police" didn't go to court to prove anything. Their employer (and no doubt lawyers speaking on their behalf) opposed a charge brought against them.

3rd example. Shocking cowardice by the cop involved. However, a case was brought by 15 undead children who were "traumatized" by the event and blamed the Sheriff, his force and the coward cop for their being upset. The judge ruled against them. Another judge, ruling in a case brought by the parents of a slain child ruled for them.

In none of those three cases was it argued that the police do not have a duty to protect the public. Not one of them is even remotely suggesting that police observing a foul crime going on in front of them (such as the vile imaginer posted) are entitled to do nothing to stop the commission of said crime.

In short, stop lying

Barillari v. Milwaukee - police have no duty to arrest the perpetrator of a violent crime who poses an ongoing threat, nor to protect his victim.

Ford v. Town of Grafton - police have no duty to enforce a protective order.

Warren v. District of Columbia - police have no duty to respond to a crime in progress.

Riss v. City of New York - police have no duty to protect someone who repeatedly seeks protection due to threats of physical harm.

So I repeat the question, Bill, what the fuck are police for, if they have no duty to protect us?

It's clear that police persons are treated in exactly the same way as you or I when it comes to a legal duty to protect or to intervene. There is apparently one law for all of us. Morally is another matter.

Barillari v. Milwaukee. False statement of the linked successful appeal. There was a duty to protect because the officer(s) involved promised that duty would be fulfilled. It wasn't. Again, the police did not take this court; the plaintiffs took the city to court.

Ford vs. Town of Grafton (note the defendant). Under the circumstances of the case, there was no duty to enforce the order. However, the case failed because of a law granting immunity to government for such a "failure" except under specific circumstances that were not met in this case. Also the plaintiff failed to renew the restraining order so there was, at the time of the injuries, no order to fail to enforce.

Warren vs District of Columbia. See first paragraph. Far from endorsing the idea that police owe no public duty, the court found "the duty to provide public services is owed to the public at large, and, absent a special relationship between the police and an individual, no specific legal duty exists".

Riss vs City of New York. The same legal hurdle as Warren. "...there is no warrant in judicial tradition or in the proper allocation of the powers of government for the courts, in the absence of legislation, to carve out an area of tort liability for police protection to members of the public. Quite distinguishable, of course, is the situation where the police authorities undertake responsibilities to particular members of the public and expose them, without adequate protection, to the risks which then materialize into actual losses"

None of these cases support the absolutist (legal) claims put forward by Scooter, no matter how sympathetic one is toward the victims in each case.
