Legal question

Post by ex-khobar Andy »

Trump has pardoned former Virginia Sheriff Scott Jenkins, who was convicted on federal bribery charges. Apparently he deputized some wealthy businessmen in exchange for $75,000.

If he were to be tried again on state charges for the same offense - I'm sure there is a state statute covering that sort of thing - would that be double jeopardy?

No, because the dual sovereignty doctrine allows an individual to be prosecuted both federally and by the state for the same acts and that doesn't fall under the double jeopardy clause.

There are many such cases in the annals of criminal justice; a recent one would be the El Paso Walmart mass shooter who was prosecuted both by Texas and the federal DOJ. Also the mass shooter who killed the members of a Bible study group at Emanuel AME in Charleston was prosecuted federally for hate crimes and murder and by South Carolina for murder.

Sometimes states don't pursue their right to prosecute when the federal government has taken the lead - for instance, the Commonwealth of Massachusetts declined to prosecute the surviving Boston Marathon bomber for murder and other charges because the feds had already nailed him with the death penalty in their successful prosecution.
For me, it is far better to grasp the Universe as it really is than to persist in delusion, however satisfying and reassuring.

What I'm not clear on is what those who paid the bribes thought they were getting out of it. He made them unpaid auxiliary deputy sheriffs, but what did that mean? Was this related to his threat to deputize people in order to get around new gun control laws? So these guys would presumably have a right to carry that other people did not?

Some people see prestige in it and other see pigs. It appears you see pigs.
I expected to be placed in an air force combat position such as security police, forward air control, pararescue or E.O.D. I would have liked dog handler. I had heard about the dog Nemo and was highly impressed. “SFB” is sad I didn’t end up in E.O.D.

Oh please do describe the 'prestige' in bribing a public servant to get a frisson in their underpants by pretending to be public servants themselves.

Post modernism on full display. There is no truth. There is no objective reality. Only reflections of particular observations, which are measurably different depending on the position of the observer. This is the old lesson of the fable of the blind men and the elephant. All are blind for no one can perceive the universe in its entirety or its eternity. Every datapoint is only relative to other data points

there is no bribery, only exchange of things of equal value. The president who once was to be so busy he would not have time to play golf, now has 'personal time' to work side hustles such as tours of the white house for individuals from foreign countries with no official reason to be there beyond 'they bought a ticket'

Trump has mastered John Boyd's OODA loop to such a high level that the usual leadership at every part of our USA is hopelessly behind. Much of the leadership of the Democratic party is frozen into inaction--they have given up and advocate just standing by and wait for Trump and Project 2025 to self destruct.

So some see prestige, some see pigs and all are equally valid, equally 'truthful'.
