Stow, a 42-year-old paramedic and father of two from Santa Cruz, has been unconscious since the attack and remains in critical condition at San Francisco General Hospital, where he was moved last Monday.

I don't watch much TV and somehow this story escaped me - I'm sure it was on NPR, but likely not covered obsessively as it likely has been in the MSM.

Anyway, it's sickening. I will keep this man in my thoughts, but the information I've read today on the family's website indicates his TBI was very severe and I would think it is highly unlikely he will ever get his life back to what it was before he went to a baseball game.

It's one thing to run the risk of such an injury in war, or on the highway - but at a baseball game?

I would wager the rest of my lifetime earnings that the two attackers were intoxicated when they attacked this guy. In the 1 1/2 years I've been doing criminal law, 99% of the violent attacks I've seen were alcohol-related. In particular, testosterone and large quantities of alcohol don't mix well.

I hope they catch both bastards, and both give statements regarding their level of intoxication in their plea bargaining process. Then I urge the family to sue the Dodgers. It's time something was done about the service of alcohol policies at major sporting events.

Sorry to be a party pooper. Somehow I've always managed to enjoy a baseball game at Fenway without getting wrecked, and some of my happiest memories of Black Bears hockey at the Alfond came alcohol-free - because alcohol wasn't served (in my day, anyway).

A few beers at the game is one thing. As much as many fans drink? Way too much - it's one reason I avoid sporting events these days, because hanging out with a bunch of drunk idiots is not my idea of a good time.
For me, it is far better to grasp the Universe as it really is than to persist in delusion, however satisfying and reassuring.

We're talking Dodger Stadium, which has a had recent problems with gangbangers.

Time to take out the garbage.

The Latest...
Stow's family sues Dodgers

Demian Bulwa,Justin Berton, Chronicle Staff Writers

Tuesday, May 24, 2011

(05-24) 15:05 PDT LOS ANGELES -- Security cutbacks, scanty lighting and a hands-off approach to rowdiness at Dodger Stadium provided a "perfect opportunity" for two men to attack Giants fan Bryan Stow outside the ballpark, Stow's family said in a lawsuit filed against the Dodgers today.

The negligence suit, filed in Los Angeles County Superior Court against the team and more than a dozen related entities, seeks unspecified damages for Stow - who remains unconscious at San Francisco General Hospital with a traumatic brain injury - as well as his son and daughter.

Stow and five friends wearing Giants apparel were harassed during a game between the two rival teams March 31, with Dodgers fans tossing peanuts and hot dogs at them, but security guards did nothing, the lawsuit says.

The suit says Stow, a 42-year-old paramedic from Santa Cruz, was worried enough that he texted a family member about the "intimidating scene."

Amy Summers, a spokeswoman for the Dodgers, said today that team officials "aren't able to comment on pending legal matters."

Investigators on Sunday jailed 31-year-old Los Angeles parolee Giovanni Ramirez, calling him the "primary aggressor" in the Opening Day beating. He has not been charged.

In a statement released Sunday, Dodgers owner Frank McCourt said, "The Dodgers are committed to providing our fans the safest sports venue in the United States."

The lawsuit seeks to link the beating to the well-publicized travails of McCourt. He is fighting Major League Baseball's naming of an overseer for his team while facing revelations - made public in a messy divorce case - that he and his wife spent millions of the team's money funding lavish lifestyles.

"It is unfortunate that such a storied and well-respected baseball club as the Los Angeles Dodgers has been made to suffer due to the cutbacks and mismanagement by its owner," wrote the Stow family's attorneys, Thomas Girardi and Christopher Aumais of Los Angeles.

What the Dodgers should have done, the lawyers write, is put more security in the parking lot, where Stow was beaten. The team should also bar "known criminals or gang members" from attending games, eject unruly patrons and promote "responsible consumption of alcohol."

The suit notes that after the attack, the team jettisoned a half-off beer promotion.

Dodgers' lawyer suggests Bryan Stow deserves blame

Staff and news services

Published 4:00 am, Friday, October 28, 2011

An attorney representing the Dodgers and their owner, Frank McCourt, suggested Thursday that Giants fan Bryan Stow might bear some responsibility for the devastating attack that left him with serious brain damage.

"One of the things the jury will be asked to do is determine what percentage of fault various individuals have for this event," lawyer Jerome Jackson told ESPNLosAngeles.com, referring to the lawsuit filed by the Stow family against the Dodgers. "You're saying to the jury, 'They (the Stow family) are saying we're 100 percent liable. But does that mean (Marvin) Norwood and (Louis) Sanchez, who beat this guy up, have no liability? And does it mean Mr. Stow himself has no liability?' "

Jackson went on to tell the website, "I've been doing these cases for 23 years and I have never seen one yet in which it didn't take at least two people to tango," referring to the notion jurors could decide Stow bears some liability in the attack. "So stay tuned and stand by."

Tom Girardi, the lawyer representing the Stow family, did not take kindly to the suggestion Stow might have helped trigger the attack.

"That's great, except people watched Mr. Stow leave," Girardi told The Chronicle in a telephone interview Thursday. "We have witnesses. He did have on a Giants jersey. I guess if that makes him responsible, he's responsible.

"We have witnesses who say these guys were throwing beer at people and yelling obscenities in the stadium. But there was no security there to stop it. ... Had the Dodgers had decent security, none of this would have happened."

Norwood and Sanchez, the two men accused of brutally beating Stow in a Dodger Stadium parking lot on Opening Day, should be held liable for potentially tens of millions of dollars in the lawsuit, according to Jackson.

Jackson filed a cross-complaint last week that argues Norwood and Sanchez - not the Dodgers - are to blame for the brain damage Stow suffered in March. Norwood and Sanchez have pleaded not guilty to one count each of mayhem, assault by means likely to produce great bodily injury and battery with serious bodily injury.

Stow's negligence and liability lawsuit, filed earlier this year and before Norwood and Sanchez were arrested, blames only the Dodgers organization and McCourt for the attack, alleging poor lighting and security problems at the ballpark. The cross-complaint adds Stow's alleged attackers as defendants.

Stow, a 42-year-old paramedic from Santa Cruz, suffered serious brain injuries during the attack. He was recently moved from San Francisco General Hospital to a rehabilitation center.

The Dodgers filed for bankruptcy protection in Delaware earlier this year, and Stow's representatives sit on the official committee of creditors. Girardi estimated that Stow's medical bills could reach $30 million, not including lost earnings and potential damages for pain and suffering.

"When somebody makes a huge mistake in life, how they're judged as a person depends not so much on the mistake but what they do to correct it," Girardi said. "How about maybe McCourt's lawyers standing up and saying, 'We got rid of two-thirds of our security. We fired the security director. We had all these incidents that took place. ... And we did this wrong to this family.' That's what you'd think they'd be saying."

An 18-year-old San Francisco Giants fan leaving Friday night's game at AT&T Park died after he was punched in the head during an argument just outside the gates, then fell over and struck his head on the ground, police said Sunday.

A second 18-year-old who allegedly threw the punch was arrested and jailed on suspicion of murder.

The victim, Anthony Giraudo, was a longtime Giants fan who often used his family's season tickets. He graduated last year from Woodside High School and attended Cañada College in Redwood City, where he pitched on the baseball team and was in the process of recovering from an arm injury, said his grieving father, Robert Giraudo.

The teen's mother, Sheri Giraudo, and father spent Mother's Day at San Francisco General Hospital, where their son's organs were donated and where dozens of relatives and friends streamed in to pay their respects. ... "

Well, Brian Stow isn't dead like this one is. So you're right, this is a lot worse.

Not to minimize what happened at At&T Park, but most people would probably be able to distinguish between a tragic one-punch accident, and a savage two on one beat down....

But then of course, our rube is not most people...

And of course he's a Dodgers fan, maybe Dodgers fans can't tell the difference....
