Sue - the claim is made by the injured party of course, just as you say. But at the large premium collection company he was associated with, it was invariably the home policy owner who called to "make the claim". Really it is the reporting of an incident that gives rise to a claim. But he thinks everyone in the biznay of screwing helping clients calls it "making a claim".No I rather think that I would be paying through the nose for my grandchild - changing diapers until I was in Depends and so on. I would also make a claim against my homeowners policy. That's why I have insurance - even here.

The headlines as usual are misleading. The above posts correctly note that this is about collecting on one or both of the insurance policies (grandmother's or the owner/builder of the staircase), and there must be enough at stake that there was not a compromise so a lawsuit had to be filed. And yes, this is why we buy insurance.

Oh anonymous supporter, it is the "occurence" of the property damage or bodily injury (using a commercial general liability policy as an example) which triggers the insurer's obligation to provide coverage, and, in Massachusetts anyway, the duty to defend. Yes, a report must be made, and if it isn't made there are possible ramifications and complications, but the key is the occurrence, not the report.
