Premeditated?

An 11-year-old boy has been charged with manslaughter, accused of using his father's gun to shoot a three-year-old boy in Detroit, US media reports say.
The boy was visiting his father in the east of the city on Monday when he took a handgun from the bedroom.
He is said to have thrown the gun out into the back garden, retrieved it and jumped into a parked car.
Later, the three-year-old boy went into the car, was then shot in the face and later died, prosecutors say.
The older boy appeared in a juvenile court for a preliminary hearing on Wednesday afternoon.
He faces another two charges of death by weapon aimed with intent, but without malice, and felony firearm.
"I cannot remember a time when we have charged someone so young with taking a life," said prosecutor Kym Worthy in a statement.
"Very unfortunately and very tragically, the alleged facts in this case demanded it."
But experts who spoke to the Detroit Free Press newspaper said it was not clear whether an 11-year-old could be competent enough to face such charges.
In Michigan, prosecutors have wide discretion to charge people of any age, though the judge has some say in the process, the paper says.
But prosecutors would have to prove that a youth, in this case 11 years old, had "criminal intent".

Bingo!
If parents - or other gun owner - were always held criminally negligent, with very harsh penalties (i.e., imprisonment), when incidents involving guns and minors occur, there would be far fewer of them.
That the vast majority of gun owning adults responsible for allowing children to get hold of guns go without consequence astounds me. Some very lazy prosecutors out there!

Six children and two adults have been found handcuffed and fatally shot in the head in a Texas home, following the arrest of a man who exchanged gunfire with police.
The gunfire broke out when officers who had been called to the Houston-area home late on Saturday spotted the body of a child and tried to enter.
A man surrendered about an hour later, after talks with police negotiators.
Police said the suspect, David Conley, was later charged with capital murder.
The Harris County Sheriff's Office said the bodies were found after "a welfare check was conducted on the premises" by deputies at about 21:00 local time (02:00 GMT Sunday).
A man inside opened fire when the deputies tried to force their way in.

Oh, BTW:
Suspect’s criminal record: According to the Houston Chronicle, the suspect’s criminal history is lengthy and includes incidents of domestic violence. In July, Conley was accused of slamming a woman’s head into a refrigerator. The address of that incident is the same as where the eight bodies were found.
In 2013, Conley was accused of assaulting the same woman who was the victim in the July 2015 case. She received an emergency protective order at that time.
A sampling of Conley's criminal record finds that he was convicted of felony retaliation in 2002 and a drug possession charge in 1994.

he surrendered when other people with guns confronted him. cowards only attack the weak, but this is too disgusting to play politics with so I ll bow out of saying anything further about this.
