A murdering asylum seeker who worked as a torturer for the Mugabe regime in Zimbabwe will not be deported - because of concerns for his safety if he returns home.
Phillip Machemedze smashed a man's jaw with pliers before extracting his teeth, one of his many victims while working for Zimbabwe's notorious Central Intelligence organisation. The 47-year-old also gave electric shocks to a white farmer, whipped a woman before pouring salt in her wounds and took part in the 'slow' killing of one of Mugabe's political opponents, The Sun reported today.
However, Machemedze 'grew tired' of his work as a torturer and apparently fearing Mugabe would turn against him, he fled to Britain 11 years ago. Despite only having a temporary visa, Machemedze has remained in the country ever since, receiving taxpayer-funded treatment for HIV. Thanks to the Human Rights Act, Machemedze and his wife Febbie, 40, who also has the disease, will continue to live and be treated in Britain at the taxpayers' expense.
At an asylum appeal hearing in Newport, South Wales, Mr Justice David Archer said Machemedze was 'deeply involved in savage acts of extreme violence'. The tribunal also heard that some of the tortures 'were too gruesome to recount'. He added: 'Whatever crimes he has committed he cannot be returned to face the highly likely prospect of torture and execution without trial, The Sun reported. The appeal hearing was brought by the Home Office and followed a judgment earlier this month which allowed the pair to stay in Britain indefinitely but did not grant asylum.
At the earlier hearing, Senior Immigration Judge Robert Martin said: 'It is true that Phillip Machemedze committed abhorrent acts and deserves no sympathy or favours. 'However, it is also true that we are bound by the European Convention on Human Rights and Articles 2 and 3 are absolute,' New Zimbabwe reported. Kate Hoey, Labour MP and head of the Commons All Party Group on Zimbabwe, said: 'This is a shocking decision. Asylum is for people who are at risk from despots, not for people like him.
'It is time Judges stood up for the human rights of decent law-abiding peaceful Zimababweans and not pander to the so-called human rights of individuals like Machemedze.
'My constituents are fed up having their hard-earned money spent on lawyers who use the Human Rights Act to defend the indefensible. '
Why don't the people that want to see crims like this recive "their human rights" become responcible for them?
Hey I understand there are people that think we should open the doors and let every or anyone come here if they claim to be a refugee.
Ok close the dention centers and I know the Human rights suporters will happily move all these unidentified people into their homes and suport them. That will take the cost of supporting the likes of Phillip Machemedze and his familyoff the public and back to the people that believe he should be taken care of.
It wont happen because these people don't believe in what they demand I should respect.

In the second, a bombshell ruling by European judges blocked the deportation of some 200 Somali criminals back to their homeland.
The Strasbourg court said the men, including drug dealers and serial burglars, might be persecuted in war-torn Somalia, and that they must be allowed to stay to protect their human rights.
So, irrespective of how heinous their crimes or the danger they present to the public, Britain has no power to expel them.
The ruling by the European Court of Human Rights stemmed from appeals against deportation by two asylum seekers convicted of a string of serious offences including burglary, making threats to kill and drug dealing.
But it will now also apply to 214 other similar cases which have been lodged with the court using Article 3 of the European Convention on Human Rights.
Article 3, which protects against torture and inhuman or degrading treatment, is an 'absolute' right, meaning that it applies regardless of the offences committed.
The two men, who were both granted thousands in legal aid to fight their cases, will now be released from immigration detention centres and will be free to walk the streets.
They were jointly awarded more than £20,000 for costs and expenses.
A frail 88-year-old woman who fled death threats in her native Zimbabwe is to be deported from the UK, just days after two immigrant criminals were allowed to stay in Britain to protect their 'human rights.'
Lydia Werrit came to Britain in 2003 as a visitor after receiving death threats from Robert Mugabe's henchmen, who had seized her farm in Zimbabwe. The frail pensioner had lived with her daughter and son-in-law in Hythe, Kent, with no financial support from the state but is now about to be deported. Mrs Werrit had never applied for indefinite leave to remain in the UK after her three-year visa ran out, and has been classified as an illegal immigrant by the UK Border Agency. She has now received a letter from the UK Border Agency telling her she must leave without delay or face removal by force.
Her imminent deportation has raised fears she may not survive if forced to go back to her homeland.
Mrs Werrit's plight was revealed just days after it emerged that two immigrant criminals - one a heroin-using driver who caused a fatal car crash and the other a double rapist - have avoided deportation after claiming it would 'breach their human rights'. Rohan Winfield, from Barbados, twice raped a professional young woman after he settled in Britain. Winfield's rape victim, a professional woman in her 20s, was 'crying uncontrollably' as she desperately tried to fight him off, according to legal papers. Following prison, Winfield should have been deported, but he successfully appealed on the basis of his human right to a family life.
Raja Mohammed Anwar Khan was high on heroin when he caused a car crash which killed a father-of-two in 2007. But after serving two-and-a-half years of a six-and-half year sentence, he also successfully appealed against deportation to Pakistan using the same argument.
Mrs Werrit, known affectionately by family and friends as Queenie, said: 'The farm was taken from us at three o'clock in the morning. 'How can they send an 88-year-old lady back to nothing?'
'These warriors came and said to me, "What are you still doing here?". I said to them, "I live here and this is my property". They destroyed everything and said if they came back and I was still here they would slit my throat. 'The threat is still there and I would be very worried about what would happen to me if I went back.'
Well it's obvious what this lady needs to do if she wants to welcomed in the UK....

The family of a disabled Ugandan drug lord who had his carer killed because they feared he knew too much are threatening to sue the health service after the gangster died.
Clifford Denty was given round-the clock treatment on the NHS after he was left paralysed in a nightclub shooting.
No expense was spared for the Ugandan immigrant. Thousands of pounds of taxpayers’ money was spent converting his council property and he was provided with a team of carers and given a converted Mercedes under a Government scheme.
But, although he was confined to a wheelchair, Denty continued his drug dealing activities to fund a luxurious lifestyle.
But when his main carer, Curtis Smith, realised the extent of his illicit activities, Denty and his brother Andrew decided he had to be silenced. Andrew Denty shot Mr Smith repeatedly in the head with machine gun.
In the wake of the killing, the NHS withdrew Clifford Denty’s care and said if he wanted further help he would have to move into a residential home.
He refused and stayed in the family home. In October last year, he died in his sleep from pneumonia and blood poisoning.
Astonishingly, despite the £1.5million of taxpayers money spent on Denty’s care, his family are threatening to sue the NHS for negligence. The family’s lawyer yesterday said: ‘In this case care wasn’t up to scratch. There was a feeling Clifford didn’t get a fair crack of the whip.’
Andrew Denty, 33, is serving a life term for the murder of Denty’s carer, while his brother Ricky was recently released from a jail term for gun running and is now fighting deportation.
Clifford Denty’s death exposed the underworld life of criminality, violence and excess enjoyed by him and his brothers which appears to have started shortly after their mother’s death in 1992.
Joyce Denty had arrived in the UK in 1987 from Uganda with three of Clifford Denty’s brothers and two other siblings.
She claimed, and was granted asylum, and settled in Streatham, south London.
Shortly after her death, Clifford and his brothers found themselves being cared for by members of the extended family and quickly descended into a life of crime.
In March 1997 Clifford admitted 14 counts of robbery and was jailed for six years. He served less than five, and was released on licence in September 2001.
Just months after his release he was shot in the back of the neck outside a south London nightclub and left paralysed from the neck down. He spent three years in hospital but returned home in a wheelchair to run his drugs empire with his brothers.
The local Primary Care Trust spent tens of thousands of pounds converting his council house near Waterloo Station to take his wheelchair and other medical equipment.
Clifford was given 24/7 care supplied by a private company contracted by the NHS, at a cost of at least £200,000 a year. He was also handed the keys to a converted £20,000 Mercedes people carrier.
Despite having no qualifications, his brother Andrew was employed as his carer and drove him around. The vehicle was also used by part-time bouncer Ricky Denty to deliver Russian-made guns.
In 2008 one of his carers, Mr Smith, told his wife and manager he had been threatened by Andrew Denty and seen guns left around the house.
In July 2008 the Andrew Denty and Smith took Clifford to the Club Red nightclub in Cable Street for a birthday party. When they left in the early hours, Andrew used a Mach 10 machine gun to shoot Mr Smith repeatedly in the back of the head. He was jailed for life at the Old Bailey in July 2009 with a minimum term of 35 years.
In April last year health officials tried to take Clifford to a care home, because they feared for the safety of the carers going into the house. But he refused to go.
The family then ran up a £13,000 bill with a private care company who looked after Clifford – and want to recover the money from the NHS.
Last night the family’s lawyer, Matthew Seligman denied the family was trying to ‘milk’ the NHS. He said: ‘The whole principle of care is that it doesn’t judge. If somebody is shot and they are on the operating table the surgeon doesn’t ask if they are a good man or a bad man.’
Stowaway illegal immigrant who committed 20 offences is awarded £17,000 ($27,250 US or $26,264 AU) compensation after being 'unlawfully' jailed for four months
An illegal immigrant who arrived in the UK as a stowaway and then committed around 20 offences has thanked a judge after being awarded more than £17,000 compensation for being falsely imprisoned by Home Office officials for four months.
Judge Stephen Stewart QC concluded that 28-year-old Joseph Mjemer - who had used at least five aliases and claimed to be from four different countries - should be freed and paid damages by the Home Office for 'loss of liberty'. The defendant who sat in court behind lawyers, told him: 'Thank you very much'.
The court heard that Mr Mjemer had been taken into Home Office 'administrative custody' in 2007 - after arriving in the UK in 2003 and committing a variety of crimes - because officials feared he would abscond if freed. The judge ruled that the detention had been lawful for most of that period - but it had been illegal between January and May 2011 because attempts to establish Mjemer's nationality had faltered and there had been no realistic prospect of deportation.
Judge Stewart said he thought there was a low to moderate risk of Mr Mjemer being violent, a moderate risk of him re-offending and moderate to high risk of him absconding. Judge Stephen Stewart QC ruled that the last four months of Mr Mjemer's detention had been unlawful He was told that Mr Mjemer arrived in the UK on a ship in 2003 and claimed asylum. Over the following three years, Mr Mjemer was convicted of more than 20 offences - including property damage, dangerous driving and attempting to obtain property by deception - and given a number of jail terms before being taken into 'administrative custody', the court heard.
He had also used at least five aliases and variously claimed to be British, Italian, Moroccan, Algerian and stateless, said the judge. Judge Stewart ruled that Mr Mjemer had been unlawfully held following a High Court hearing in London in May.
There was a feeling Clifford didn’t get a fair crack of the whip.’
A "crack of the whip" is exactly what Clifford deserved....

An illegal immigrant who claimed to be paralysed from the neck down but was filmed dancing at his wedding cheated more than £400,000 in benefits, a court heard yesterday.
But even though Mohamed Bouzalim, 37, has admitted dishonestly entering the country and fraudulently exploiting the welfare system, legal sources said they will face an ‘uphill battle’ to deport him.
There is a strong likelihood the Moroccan will be able to remain in the UK by claiming he has a right to family life under Article 8 of the European Convention on Human Rights, immigration sources said.
His total haul of around £400,000 was from Camden Council, the Department for Work and Pensions and the Independent Living Fund, the court heard.
The fraud ended when UK Border Agency staff raided his home in Kilburn, north London, last year.
In it, they found a video of Bouzalim performing energetic dance moves at his own wedding the previous year – miraculously without his wheelchair.
Disability aids he had received, including a wheelchair ramp, were still in their boxes at his home.
Bouzalim, who has been in custody for 18 months, has pleaded guilty to 11 charges of dishonesty. His brothers Rachid, 35, and Abdallah, 39, and sister Zahra, are all on bail having also admitted fraud charges.
Yesterday, the Moroccan appeared in court sitting in a wheelchair, wearing glasses, a red shirt, grey tracksuit bottoms and black plimsolls. He had wild Afro-style hair and a straggly beard.
Accompanied by two nurses, he appeared to struggle to raise his arm and speak when asked if he was present by the court clerk. However Judge Simon Oliver cast doubt on defence claims he was unwell, referring to a psychiatric report from the medium-secure unit in Southall, west London, where he is being held.
‘He is described as a malingerer,’ the judge said, adding from the report: ‘A person who deliberately pretends to have illness or disability in order to obtain gain or otherwise evade responsibility.’
My dogs are useless as guard dogs, they will let anybody in.

A gang of Muslim girls who repeatedly kicked a young woman in the head walked free from court after a judge heard they were 'not used to being drunk' because of their religion.
The group screamed 'kill the white slag' while kicks raining in on 22-year-old Rhea Page as she lay motionless on the ground, the court heard.
The attackers - three sisters and their cousin - were told by a judge that normally they would have been sent to jail.
However, he handed the girls - all Somalian Muslims - suspended sentences after hearing that they were not used to alcohol because their religion does not allow it.
Their victim was left with a bald patch after they pulled a chunk out of her hair during the attack on the High Street, Leicester.
Ambaro and Hibo Maxamed, both 24, their sister Ayan, 28, and cousin Ifrah Nur, 28, attacked Rhea, a care worker, as she walked to a taxi rank with her boyfriend after a night out.
The victim, a support worker, was left so traumatised that she lost her job following repeated absences with stress and flashbacks, Leciester Crown Court was told.
The charge - assault occasioning actual bodily harm - carries a maximum sentence of five years in prison.
James Bide-Thomas, prosecuting, said Ambaro Maxamed, who started the violence, had called Miss Page a 'white bitch' during the incident.
The women, who are all Somalian Muslims, were not charged with racial aggravation.
Victim Miss Page said: 'I had gone for a drink after work and then I met my boyfriend for a couple more before heading home.
'We didn't want to stay out too late so we went to get a taxi and all of a sudden I heard these women shouting abuse at me.
'We were just minding our own business but they kept shouting "white bitch" and "white slag" at me.
'When I turned around one of them grabbed my hair - she literally wrapped her fingers in my hair - then threw me on the ground. That's when they started kicking me.
'They were taking turns to kick me in the head and back over and over. I was lying on the ground the whole time, crying and screaming. It was terrifying. I thought they were going to kill me.
'Eventually the police came but it felt like ages. Afterwards I was covered in blood and hair.
'I had a bald patch on my head where they had yanked my hair out and I was black and blue all over.
'I honestly think they attacked me just because I was white. I can't think of any other reason.'
She suffered bruises and grazes to her head, back, legs and arms, and had clumps of hair pulled out.
