Think about it... If you use a sample from another song in your recording are you:

a.) Implying that you can improve the original thus insulting the composer(s)
b.) Needing to use somebody elses work to bring your own up to scratch and therefore in the wrong business!
c.) Geoff Hurst in the 1966 World Cup final*

*Multiple choice questions have to include one obviously wrong answer. It's a tradition, or an old charter or something...

Sean, the sample was paid for and authorised..
The Verve negotiated a license to use a five-note sample from an orchestral version of one of the Rolling Stones’ lesser hits, “The Last Time,” and received clearance from Decca Records

Yes but the charge was using a larger sample than was paid for. Ashcroft denied this but later settled out of court.

My thought at the time was that if he being totally truthful it could be easily proven with the original recording masters...
