Bum deal for gnome

A man has been told to remove a gnome which is baring its bottom from a patch of grass at a road junction.
Laurence Perry, 76, of Wistaston, said Cheshire East Council told him to remove the ornament within seven days.
Mr Perry, who said the gnome's bottom "lights up" at night, added: "I've not told him... I don't want to upset him."
The council said such objects "could easily" distract motorists, as first reported by the Nantwich News.
It said it had received a complaint and while the authority did "not wish to spoil people's fun", there was "a safety issue here".

Just as tasteless as this:
It is ridiculous that this is a town council matter, but if he likes it, he should have it in a more private part of his property. It's kind of like he wanted attention or something.

Just call it a
'caganer' rather than a gnome, claim it's traditional, and that he's just decorating early for Christmas.

It's not clear to me that this gnome is on private property. I think it looks like an island in the right-of-way, and the article makes it sound like this guy is one of the many good citizen who volunteer to maintain/plant/beautify these little strips of land.
If it's not private property, if it's counsel property, then they have every right to tell him to take it away, and he is lucky they didn't just remove it themselves.

I gotta say, I'd be distracted from my driving if I passed glowing gnome glutes by the roadside at night.
