A lawyer acting for Chubby Checker, the musical legend behind The Twist, has announced a lawsuit against tech-giant Hewlett-Packard for using the singer's name for a penis-measuring app.

The "Chubby Checker" app, which appears on websites for Palm devices, claims to allow a person to determine a man's penis size by using his shoe size.

In a statement this week, attorney Willie Gary said the suit named HP and its subsidiary Palm, for marketing the software application without permission.

The suit filed a Florida federal court seeks $US500 million in damages.

According to Gary, it alleges the app "adversely affects Chubby Checker's brand and value ... and will tarnish his image that he has worked to maintain over the last 50 years."

"This lawsuit is about preserving the integrity and legacy of a man who has spent years working hard at his musical craft and has earned the position of one of the greatest musical entertainers of all time," said Gary.

"We cannot sit idly and watch as technology giants or anyone else exploits the name or likeness of an innocent person with the goal of making millions of dollars," he added.

"The defendants have marketed Chubby Checker's name on their product to gain a profit and this just isn't right."

Checker, 71, is best known for his 1960 hit The Twist, which spawned a dance craze during the decade that followed.

So Checker figures that without this app, the future earning potential for his "career" would be in the range of 500 million?

This man is on drugs...

Chubby, I hate to break it to you dude, but I'm certain that there are a whole lot of folks who didn't even know you were still alive....

I know this for a fact because I'm one of them....

Regardless, if someone mentioned Chubby Checker to you, would you think of a penis measuring device or some old time rocker?
And is it right for someon to use his name (claim to fame) to promote said app?

I would think "Chubby Checker" would be copyrighted by now.

As an aside, it seems only natural that a 'Chubby Checker' would run on a palm device. It gives an interesting twist to the name....

I recall hearing years ago that the stage name "Chubby Checker" was thought up by Dick Clark's wife back when Checker first started appearing on American Bandstand....

The purpose of the name was to capitalize on the popularity of Fats Domino and sort of play off his name....(Maybe Fats should have sued Chubby...gee that really looks strange in print...)

My favorite celebrity lawsuit involves Johnny Carson...

Years ago (when Carson was still hosting the Tonight Show) a portable toilet company came out with a line of toilets that they called "Here's Johnny"...(They printed the name on all the doors)

Mr. Carson took umbrege at this...not particularly caring to have his name and famous signature Tonight Show line plastered on thousands of outdoor shitters....

As I recall it, he didn't actually sue, (he wasn't after money; he just wanted them to change the name) but threatened to do so, and the company changed the name.

The largest part of the fat demand is probably punitive damages, and beyond damage to his career, he would be entitled to whatever profits the company makes on the app estimating app size. He would do well to have used the same strategy as Johnny Carson, unless he wanted to remind us all that he is in fact, still alive and ready to do the twist again.

Not since my father's cover band opened for him about 25 years ago.

He's alive...put in an appearance about 5 years ago at a benefit concert for Katrina recovery. (He lives in New Orleans.) He's 85.
