A driver caught waving his hands in the air as he passed a speed camera has been handed a £1,000 fine and given 10 points on his licence.
Jerry Weeks, 32, was captured travelling at 46mph in a 30mph limit on North Prospect Road, Plymouth, by a mobile speed detection unit.
The images showed he had both hands off the wheel of the Honda Civic and was waving them about as he went by the camera.
Weeks, who appeared before Plymouth Magistrates’ Court on Thursday, was nominated as being the driver of the vehicle at the time of the offence when a Notice of Intended Prosecution (NOIP) was sent to the car owner.
However, his first name had been misspelt as “Jessy” by the nominator. Two further NOIPs went without a reply and when Weeks was visited by a police officer he disputed the validity of the notice and claimed he had not opened the first two letters as it was an offence to open someone else’s mail. He then shut the door.
He was later visited by another police officer and was personally served a the notice with his correct details which he did not return.
In court, Weeks challenged the accuracy of the speed detection equipment, the competency of the operator and validity of the Notice.
He admitted to being the driver of the car but not to the excess speed. He claimed to have returned his final notice but admitted not signing it, saying he had heard it was a “loophole”.
Magistrates said a “typographical error” was no defence to not replying to the notice and that the minor error in the spelling of his name was not sufficient to invalidate the Notice.
Weeks then refused to give his income, so the fines could be means tested. His last quote to the bench was: “Go on. Do your worst.”
For the speeding offence he was fined £400 and given four penalty points. For failing to identify the driver he was fines £600 and given 6 penalty points.
He was also order to pay costs of £650 and a victim surcharge of £100.
