Jury of six men and six women return verdict on Paul Manafort at end of the first trial brought by Robert Mueller's special counsel probe
He was found guilty of eight of the ten counts of fraud on the fourth day of deliberations - the jury deadlocked on the other ten
Juror Paula Duncan says one sole holdout prevented conviction on all 18 counts
The mother-of-two, an avid Trump support, said that behind closed doors, tempers flared as they clashed but the sole juror couldn't be convinced
Duncan said her devotion to President Trump left her feeling conflicted but she was persuaded by the prosecutors' arguments and four full boxes of evidence
Kind of what we thought. If the judge had accepted 11-1 it would have been a clean sweep. That brings to mind two questions. If 11-1 or 10-2 is legitimate why isn't that the case from the beginning rather than an option introduced after several days of deliberation? Secondly: as a practical matter, what difference does it make in this case? The counts on which he was found guilty are more than enough to put him away for a substantial time. Could the judge have known this? We knew after some time on Tuesday that the jury was unable to reach a decision on some of the counts but of course we did not know if the ones they had resolved were guilty or not. If the judge had known - OK we have him guilty on 8 counts but it's 11-1 on the others - he might have thought - that's fine, he's going down. But if he knew that the 8 counts were not guilty but they were 11-1 for guilt on the other counts, he might have been tempted to say - OK I'll take 11-1.

I’m not sure I understand your question Andy. In a criminal proceeding on federal charges, the jury must be unanimous. Supermajorities are only allowed in some civil proceedings in some states.

OK thanks Guin. There was certainly speculation in something I read about the judge being able to accept a less than unanimous verdict, but clearly that was uninformed. I did not know that it was only in civil trials that a majority might be acceptable. Also (I just looked it up n Wikipedia which is always correct) some states accept supermajorities in criminal trials.

Only Oregon and Louisiana, at present. There is a great deal of legal scholarship on the issue that makes for interesting reading.

My new girlfriend, Donna Jean, and I were recently talking and she's sure a red wave is coming. She also mentioned the Dems don't stand a chance in November. I'm not going to argue... I suppose I'll just go with the flow.
