It doesn't change the righteousness of the complaint(s) but should not have been submitted with such an error.President Trump likely was particularly anxious to see Mr. Comey indicted quickly because the statute of limitations for the alleged offenses was set to expire on September 30, 2020 (five years from the date of the alleged conduct under 18 U.S.C. § 3282).
A judge has dismissed charges against former FBI Director James Comey and New York Attorney General Letitia James.
The judge ruled that the appointment of the Justice Department's lawyer, Lindsey Halligan as interim US Attorney was unlawful and violated the Appointments Clause in the US Constitution.
BSG--from what I have read, this 6 month window should not apply because the indictments were not properly brought, and are not valid. I think the ruling can be appealed, but that refiling should not be possible. Then again, who knows what will happen. Next up will the DOJ appeal; apparently they have six other similarly appointed US Attorneys around the country who under the same facts are improperly appointed as interims in violation of the appointments clause.
