To a certain extent that's true, but many practices, from use of stress positions, to interrogation round the clock for hours, to sleep deprivation, to outright torture can strongly encourage, if not make, one talk against his interest--which is why we have the right to counsel and the right to refuse to answer anything. The news media are treating the exception as applying only to the elimination of the requirement to give the Miranda warnings, but my guess is that it goes much further.

It has been reported that the older brother's car had a license plate on the front of his car that said either "Terrorista 1" or "Terrorist 1".

Wouldn't ya think that plate might have brought some attention to him at some point?

Thank god I NEVER do anything wrong or illegal. Since 1979 my PA automobile tag has read "GUILTY." Why? I was raised catholic. Any questions?

I'm just glad I wasn't visiting my relatives in the Boston area on Monday. If the BPD had spotted my plates I'd be in for a heap-o-trouble. The Boys are really good at giving out the ol' "wood shampoo" in the elevators at the Plaza.

I would certainly hope not....

It seems to me the whole advantage of being able to question him without mirandizing him is to be able to question him without an attorney...

The downside to this procedure is that they wouldn't be able to use a confession in court, but it's not like they need a confession to make their case against him.

BOSTON (AP) — Federal public defenders have agreed to represent the suspect in the Boston Marathon bombings.

Miriam Conrad, the federal defender for Massachusetts, says her office expects to represent Dzhokhar Tsarnaev (joh-KHAR' tsahr-NEYE'-ehv) after he is charged.

Tsarnaev remained hospitalized Saturday after being wounded in a firefight with police Friday. His brother was killed.

Conrad says she believes Dzhokhar should have a lawyer appointed as soon as possible because there are "serious issues regarding possible interrogation."

U.S. officials said a special interrogation team for high-value suspects would question him without reading him his Miranda rights, under a public safety exception that exists to protect police and the public from immediate danger. Miranda rights include the right to remain silent and the right to have a lawyer.

It might be successfully argues that this cretin, due to such horrendous subversive activity, took a false oath of US citizenship last year. I feel that there was concealment of facts, or straight out lying, about important issues at the time this asshole was interviewed by the Citizenship and Immigration Service about his application for naturalization.

Of course, it may be a legal broad stroke but it appears to me that this "alleged" bomber should have his citizenship revoked. I surely feel the nature of this crime supports such action. Violent extremism at its most calculated. Squeeze him dry and place him in solitary for the rest of his unnatural, miserable, life.
