An Italian court on Thursday convicted American Amanda Knox and her former Italian boyfriend Raffaele Sollecito for a second time for the murder of a British student in Perugia in 2007.

The court sentenced Knox to 28 years and six months in prison and Sollecito to 25 years.

Italy’s highest court ordered the third trial for Knox in a scathing dismissal of the appeals court acquittal, ordering the examination of evidence and testimony it said had been improperly omitted by the Perugia appeals court as well as to redress what it called as lapses in logic.

So what is it now, 2 courts in favor of conviction, 1 against? I presume under Italian law this can go on forever?

So what happens next? Will the USA agree to her being extradited?

I don't know the exact law, but my understanding is that it's optional to the state department. From a legal point of view, I would think that the fact that she was acquitted (not just granted a new trial) by the appellate court a while back would go a long way to the US refusing to extradite. In the US once you are acquitted you cannot be tried for the same offense again. My giess is she will not be extradited, but if she ever travels outside of the US, she might well be arrested (the same way Roman Polanski was in Switzerland (as I recall) based on a US court ruling).

She can appeal to the Supreme Court of Cassation (the same court that threw out the appeal verdict and ordered this most recent retrial). I believe at that point the court can either uphold the verdict or overturn it; I don't know if returning it to a lower court for a retrial is an option. News reports seem consistent in saying that the process will be done with one way or another in about a year.

This is momentous. Scooter and I agree on something.

For reasons that I can't figure out myself I am as interested in this case as I was the old OJS one of yore (I understand his son did it, eh?).

I took the time to locate a translation of the original court report ("Sentence of the Court of Assizes of Perugia"), and to read most of it. It is astounding how many people in the media are reporting on this case and have NO IDEA what the evidence was or how the original verdicts were explained.

I was looking for an "Aha!" moment or bit of solid evidence "proving" that Knox and Sollicito actively participated with Guede in the sexual assault and murder, and I found no such dispositive evidence in the writeup. But using an analogy of a jigsaw puzzle with about half the pieces missing, the picture that comes out of the evidence that does exist is one that undeniably includes those two as participants. In addition to some physical evidence that could be considered ambiguous or tainted, the defendants themselves were acting like people who were guilty as hell, and doing everything they could to divert attention from themselves to anyone else they could find, even an imaginary burglar.

Most telling in my opinion were the lies that made no sense OTHER THAN to hide where they were and what they were doing between the evening of November 1 and the morning of November 2. It is undeniable that the two of them were outside the Kercher apartment late on the night of the murder, and that Knox was up and about at 0700 the following morning, apparently buying cleaning supplies at a local market. And of course they both claimed to have been in Sollecito's apartment, together, from mid-evening through 1030am.

Anyway, their guilt has almost become secondary to criticism of the Italian court system, the prosecutor, and the Italian press. There is little doubt that we will be seeing a diplomatic kabuki dance around the end of 2014, as the Italian authorities demand Knox's extradition, and we have no legitimate reason not to send her back.

Amanda Knox murder conviction overturned by Italy high court

ROME (AP) — Italy's highest court overturned the murder conviction against Amanda Knox and her ex-boyfriend Friday over the 2007 slaying of Knox's roommate, bringing to a definitive end the high-profile case that captivated trial-watchers on both sides of the Atlantic.

"Finished!" Knox's lawyer Carlo Dalla Vedova exulted after the decision was read out late Friday. "It couldn't be better than this."

In a rare decision, the supreme Court of Cassation overturned last year's convictions by a Florence appeals court, and declined to order another trial. The decision means the judges, after thoroughly examining the case, concluded that a conviction could not be supported by the evidence.

Experts have said such a complete exoneration is unusual for the high court, which could have upheld the conviction or ordered a new trial as it did in 2011 when the case first came up to the Cassation's review on appeal.

The justices' reasoning will be released within 90 days.

The decision ends the long legal battle waged by Knox and Italian co-defendant Raffaele Sollecito. Both Knox, who awaited the verdict in her hometown of Seattle, and Sollecito have long maintained their innocence in the death of British student Meredith Kercher.

The Kercher family attorney, Francesco Maresca, was clearly disappointed by the ruling.

"I think that it's a defeat for the Italian justice system," he said.

Across the Atlantic, a spontaneous shout of joy erupted from inside the Seattle home of Knox's mother as the verdict was announced. Several relatives and supporters filtered into the back yard, where they hugged and cheered.

Dalla Vedova said he called Knox to tell her the news, but said she couldn't speak through her tears.

"She was crying because she was so happy," he said.

The case aroused strong interest in three countries for its explosive mix of young love, murder and flip-flop decisions by Italian courts.

Kercher, 21, was found dead Nov. 2, 2007, in the apartment that she shared with Knox and two other students. Her throat was slashed and she had been sexually assaulted.

Knox and Sollecito were arrested a few days later. Eventually another man, Rudy Guede from Ivory Coast, was arrested, tried and convicted of the murder in a separate trial and is serving a 16-year sentence.

The couple maintained their innocence, insisting that they had spent the evening together at Sollecito's place watching a movie, smoking marijuana and making love.

Knox and Sollecito were initially convicted by a Perugia court in 2009, then acquitted and freed in 2011, and then convicted again in 2014 in Florence after the Cassation court overturned the acquittals and ordered a new appeals trial.

That Florence appeals conviction was overturned Friday.

Sollecito's lawyer, Luca Maori, called the young man with the good news from the steps of the courthouse.

"You have your whole life ahead of you now, Raf" he told Sollecito.

Telling reporters, he added: "He almost couldn't speak. Eight years of nightmare over."

Here's something I changed my mind about...

I started off believing she was certainly guilty, but over time it became apparent that the physical evidence against her was extremely weak, the conditions that her so-called "confession" was obtained under were shameful and would never have been allowed in a US court, and the prosecutor's unethical publicity seeking behavior made him essentially the Italian version of Dennis Nifong...

It really started to look like a "railroad"...

The more I looked into it, and the more I learned about the quality of the "evidence" against her, and the conduct of the police and the prosecutor, I went from "Of course she's guilty, string her up!" past "there's reasonable doubt" all the way to "this girl is almost certainly not guilty"...

I'm glad to see this is finally over for her...It's the right decision.

When I first heard about this case I believed Amanda would be found not guilty based on what I had read and heard on the radio at the time. After reading what Scooter had written about it, I didn't know what to believe.

I agree that the verdict was correct.

The guy who killed her is the guy in prison and he should have gotten way more than 16 years for the crime. The Italian prosecutors screwed the case up, but the cops did even worse from the first moment, mishandling the evidence, etc. Was Knox, or her boyfriend, in any way involved? I don't tend to think so . . . but in any case, there was massive reasonable doubt about their guilt.
