We have this thing here called "innocent until proved guilty", it's quite popular. The train was going more than 2x the speed limit for that area. > 100mph There is no reasonable explanation for how a train conductor could make an error that gross while awake and conscientiously performing his job.

That's quite an assumption, rubato. He might have experienced a medical emergency. The train might have experienced mechanical issues. Directly following the derailment, he was suffering from a head trauma and not able to remember what happened immediately preceding the event. That is typical response to head trauma.
When somebody has been in an incident of any kind involving potential liability, criminal charges, etc., s/he has the absolute right to seek legal advice. It's further a very wise choice to make. If you ever find yourself in those shoes, I'm quite sure you will seek legal advice, too.

Even if the engineer had absolutely nothing to do with the accident, not consulting a lawyer as soon as possible would have been foolish.

The only assumption is that very highly unlikely events did not occur. Events of minute probability. Trains are very big and very heavy. A lot of inertial mass. They accelerate very slowly as a result. He has a right to seek legal advice but doing so shows a devotion to self-interest and a lack of interest in the welfare of others.
It is possible that there is evidence which will reduce his guilt but at the moment I think it is very unlikely.

Brandon Bostian, was "extremely co-operative", the National Transportation Safety Board said, but he could not remember what happened.
The train derailed as it hit a curve when travelling at twice the speed limit, killing eight people.
The 32-year-old driver had called for stricter rail safety.
On various posts to Trainorders.com, Mr Bostian lamented Amtrak's lack of Positive Train Control, an automatic braking and warning system which was not fully operational on that section of line.

The FBI will examine the windshield of the locomotive that derailed in Philadelphia, trying to determine if it was damaged by a projectile or a bullet before this week’s fatal crash, National Transportation Safety Board member Robert Sumwalt told reporters Friday night. This latest twist comes after an assistant conductor told investigators she believed she had overheard the train’s engineer talking about something striking the train, Sumwalt said.
“Our investigation has not independently confirmed this information, but we have seen damage to the left-hand lower portion of the Amtrak windshield that we have asked the FBI to come in and look at for us,” he said.

Investigators have already reported the train rapidly accelerated just on the approach to the curve - and they are train crash investigators so I think they know how trains work?
News is now reporting that before the derailment the engineer reported his window was hit by some kind of projectile; two other trains were also hit in the same are in the same time period. FBI is investigating.
The engineer is cooperating fully after talking to his fucking lawyer, but has no independent recollection of the moments before the derailment. Doctors say his memory may return with time but may not.
