Don't be so sure.

And don't be so sure that a lone person with a gun has much protection against even a small gang of persons who are also armed; certainly training can help to even those odds, but most people are not even trained in how to shoot, let alone in defense tactics.
no one is arguing that nut jobs should be able to legally bear arms.
Specifically saying "nut jobs" should be able to legally bear arms, probably not; but then defining what a nut job is proves very difficult. Is a man who hit his wife and threatened her enough of a nut job so he should be denied that right. Where is that line drawn. And some will argue against each and every restriction as "whittling away our rights" --a frequent NRA position.

And how do we screen nut jobs? Should we have a waiting period to allow for the background check? A lot of people would scream no. Or limitations on private sales except when a firearms dealer runs a background check? Same screams.

Face it, we need to get a workable system in place to enforce even our current laws, but that's the last thing some on the other side of the debate want.

You know what I found odd.
In order to get a hunting license I had to take a safety course (which was free).
I only needed money to buy my rifle.

Oldr--you didn't need to get fingerprinted and investigated to get a firearms ID card before you could buy a rifle or long gun? That's what they do in NJ, and I would have thought NY to be similar.

Same in Ohio. A regular long gun is cash and thank you. They do feature in very few high profile mass shootings etc. Handguns are a much bigger problem and therefore more stringently regulated. Solution. Buy a black powder replica Navy Colt or Remington - purchase the cylinder swap-out and start loading .44 mags instead.

I always thought replicas were manufactured with softer barrels so they could not be fired. Is this not the case? IN NJ, I believe you need a firearms ID for even BB guns, so a black powder weapon that could be fired would be subject to the same restriction.

Not when I bought it. (25+ years ago, got the hunting license the same year. No expiration date on the license)
I am tempted to go and try and buy a shotgun and see if my mental problems from a year ago come up on a background check. I would think a suicide attempt would show up and stop me from getting a rifle.
Handguns in NY are alomst immpossible to get even before the national registry.

ETA
I seem to recall having to produce ID when getting the rifle.

Generally the only thing that registers is if a person has been committed against his will to a mental health facility; unfortunately most states are terrible at even getting that info entered into NCIC, so the limitations are largely useless.

is if a person has been committed against his will to a mental health facility
My wife called the ambulance and I spent 4 days in the regular hospital (with round the clock supervision) then was transfered to the psych ward for 8 days.
I did not indicate I did not want to go so I guess it was voluntary. Also have been in counseling and group therapy for the past year with a counselor and a shrink.
I could "graduate" if I wanted to, but I like going.

Last time I checked You can buy black powder handguns via the mail or internet.

I guess it depends on the state, but my understanding is that firearms cannot be shipped interstate (across state lines) except to a registered firearms dealer, who is required to certify that the laws in the recipient's state are complied with. Indeed, I once checked into shipping one's own guns into NJ for a friend of mine who was moving here from Oklahoma. and the law required that they be shipped to a licensed dealer who would have to hold them until he got his firearms ID card, handgun permits, etc. They could not just be packed on the moving van or thrown into his car.

I do recall reading that intrastate sales (sales solely within a single state) are different depending on the state and private intrastate sales are unregulated in many states. Craig's list type sites have sprung up to bring such buyers and sellers together in these states.

I'm not sure about any exemption for operable black powder guns, but I do think there may be some relaxation of the rules for genuine antiques.

Look it up yourself. You can order a working replica delivered to your door with no FFL. Powder and percussion caps you're better off buying in person ( because of the cost of shipping dangerous goods) but most gun stores have them.

I'll see if I can find such a site, but given the fact that NJ doesn't even permit ownership of a BB gun without a permit, I doubt it could be shipped legally into this state. But the laws don't always make sense, so who knows.

They aren't considered a "firearm" under federal law. Even a felon can have one.

I suspect that will last until the first time there is a lurid crime where BP guns are used.

thanks rubato; apparently they are considered antique firearms if they cannot undergo the swap out meade talked about. However, while NJ exempts antique long guns and rifles from control, it requires a permit even for antique pistols. Indeed, I googled antique postols and NJ and found a recent case where a 72 year old had an antique pistol in his house and is facing jail time.

Perhaps, but Charlton Heston had a lot of new firearms, as well as an old staff that could part seas.
