Scalia: Black students do better at 'less-advanced' schools than UT

Black students may do better at "slower-track" schools than the University of Texas at Austin, Justice Supreme Court Justice Antonin Scalia said Wednesday as the state's flagship defended its race-conscious admissions policies before the high court.

Scalia, a well-known critic of affirmative action policies at stake in the case, also suggested that black scholars come from "less-advanced" schools.

"Most of the black scientists in this country don't come from schools like the University of Texas," he said, citing a brief, according to transcripts from the hearing. "They come from lesser schools where they do not feel that they're -- that they're being pushed ahead in -- in classes that are too -- too fast for them."

UT is defending its consideration of race in admissions for about a quarter of incoming students. Three-quarters of UT's incoming class is automatically admitted through a state law granting admission to the top-ranked high school graduates in Texas.

The Texas Exes, UT's alumni group, said in a tweet Wednesday that Scalia's comments were "racist and offensive."

UT has broad backing, but higher education leaders and civil rights groups are concerned that Abigail Fisher, a white woman from Sugar Land who says she was discriminated against when UT rejected her in 2008, could strike a serious blow to affirmative action.

The core of UT's argument is that it needs to consider race to ensure diversity among its student body -- a goal supported by the U.S. government, the country's biggest businesses, former military leaders and many more, who filed dozens of briefs in UT's favor.

Scalia, however, questioned whether UT needs to increase its black student population -- which currently makes up about 4 percent of the student body and has not grown in a decade.

"I'm just not impressed by the fact that – that the University of Texas may have fewer (black students). Maybe it ought to have fewer," Scalia said. "I don't think it – it – it stands to reason that it's a good thing for the University of Texas to admit as many blacks as possible."

Ain't it a bit weird.... university is almost the opposite of diversity (in one sense)
For Christianity, by identifying truth with faith, must teach-and, properly understood, does teach-that any interference with the truth is immoral. A Christian with faith has nothing to fear from the facts

Scalia is an ass. Smart but sly, and he is aging rapidly and losing his filter, so we see more and more of his true assholery (and he never fooled Andrew for a second, btw).

Scalia, agree with him or disagree with him, was for many years, the brightest person on the Court...

Until John Roberts arrived...

No. He is just the biggest self-promoter on the Court.

The brightest is The Notorious RBG. Hands. Down.

The most intellectual is probably Lord Breyer.

Roberts is smart, don't get me wrong. And savvy. You realize, of course, he and Justice Kagan have almost the same resumes.

I have watched at least parts of a lot of confirmation hearings over the years for a lot of offices, (Chuck Hagel...worst hearing ever)

But the hearing I have always been most impressed with, was John Roberts in front of the Senate Judiciary Committee...

I think they should take excerpts from that and teach it in AP civics classes in high school...

Not only was he able to speak at length (without notes) on every obscure legal question they could throw at him, he did so in an avuncular easy going style, that was easily intelligible to the layman...and he laid out "the big picture" in the same fashion...

I found his hearing to be incredibly educational; and it's not often at my age, (or even the age I was 10 years ago when he was confirmed ;) ) that I can say that...

After his first session, I thought to myself, "This guy is clearly the smartest and most knowledgeable person in the room...far brighter than any of those relatively dimmer bulbs sitting on the Committee..."

But he also didn't act like an arrogant jackass...

(I'm sure that at his confirmation hearing Robert Bork was also the smartest person in the room, but he acted like a petulant turd...)

Roberts was an incredibly articulate font of legal knowledge, but at the same time the sort of guy who could be your next door neighbor; "Hey John, can I borrow your hedge shears?"


Nobody would have ever asked Robert Bork that question...

Unless they wanted to wind up with a set of hedge shears planted in their spine... ;)

Scalia's point is one that has a great deal of traction and has been demonstrated through thousands of examples - for anyone willing to look at reality rather than Hopes & Dreams.

The benefit to the individual or to society of admitting "Blacks" to schools where their academic bona fides do not measure up is questionable indeed. Is it better to be one of the dimmest bulbs in the class at Yale or one of the brightest at Penn State? Black dropout rates at elite schools are much higher than average, they study majors that lack academic rigor, and they force the schools to compromise on both course selection and grading. All in the name of "diversity" - a bullshit goal in the first place.

Who wins? The black woman with a degree in Ethnic Studies from Berkeley? She'll be one hell of a good social worker (or Community Activist), won't she?

Scalia has been, and continues to be, a brilliant legal scholar and analyst. And as a result he is the constant subject of ad hominem criticism from the Left (oddly, never citing any specific cases of flawed analysis). Not to worry. He is bigger than his adversaries.

In my opinion, you learn about a Justice's intelligence and abilities by reading their opinions. But what do I know :geek:

WASHINGTON (The Borowitz Report)—A new study conducted by legal scholars indicates that Justice Antonin Scalia would fare better if he served as a judge at a court that was “less advanced” than the United States Supreme Court.

According to the study, Scalia’s struggles to perform his duties in a competent fashion stem from his being inappropriately placed on a court that is “too demanding” for a person of his limited abilities.

“Forcing Justice Scalia to weigh in on complex legal issues that he lacks the background or aptitude to comprehend is, at the end of the day, cruel,” the study said.

The legal scholars theorized that Scalia would be more likely to thrive in a “lesser court where he does not feel that he is being pushed to hear cases that are too challenging for him.”

“If Scalia were reassigned to a ‘slow track’ institution such as a town traffic court, that would be better for everyone,” the study recommended.
