Refugees detained at U.S. airports challenge Trump’s executive order


Refugees who were en route to the United States on Friday evening have been detained at U.S. airports and restricted from the country as a result of President Trump’s executive order banning their entry.

Lawyers for two Iraqi refugees detained at New York’s John F. Kennedy International Airport filed a middle-of-the-night lawsuit in federal court challenging Trump’s executive order as unconstitutional and seeking the release of their clients.

They also are seeking class certification so they may represent all refugees who are being similarly held at U.S. ports of entry. Immigration advocates say at least one refu­gee family is detained at San Francisco International Airport, but it is not clear how many refugees are currently detained at airports nationwide.

Trump’s executive order suspends admission of all refugees for 120 days and calls for a new system to tighten screening of those seeking entry to the U.S. from predominantly Muslim countries. Trump said that the goal is to screen out “radical Islamic terrorists” and that priority for admission would be given to Christians.

Both Iraqi men now detained at JFK had been receiving pro-bono legal assistance for several months from the New York-based International Refugee Assistance Project. Betsy Fisher, the organization’s policy director, said the men were in the air on separate flights when Trump signed the temporary ban on refugees Friday. She called their detention “our worst-case scenario.”

“In the coming weeks we will be advocating to show why this policy is bad for U.S. national security, why it goes against our humanitarian responsibilities, and why it is fundamentally un-American,” Fisher said. “If there is one fundamentally American value then it is welcoming those who are fleeing persecution. At our best, this is what we can do.”

One of the Iraqi men detained at JFK, Hameed Khalid Darweesh, 53, had worked as a contractor for the U.S. government in Iraq for about a decade, including as an interpreter for the Army. He and his wife and three children had spent more than two years trying to secure visas to come to this country.

The Darweesh family landed in New York at approximately 6 p.m. Friday evening, and Hameed Darweesh was detained by U.S. Customs and Border Patrol officials, according to the complaint filed in U.S. District Court for the Eastern District of New York. He has not been allowed to speak with his attorneys and is at risk of being returned to a country where he faces enormous risks to his personal security due to his aid to the U.S. government, the complaint says.

The other detainee is Sameer Abdulkhaleq Alshawi, 33, who was planning to join his wife and young child in Texas. His wife had worked for a U.S. government contractor and came to the United States as a refu­gee in 2014.

Marielena Hincapie, executive director for the National Immigration Law Center, said immigration advocates first learned of immigrants being detained Friday evening after a report from a family detained in San Francisco. The advocates attempted to reach U.S. Customs and Border Patrol but were unsuccessful.

“We were trying to find out if it was lack of communication or what was the plan?” she said in an interview Saturday morning.

Lawyers for the two Iraqis held in New York have been unable to speak to their clients. When the lawyers asked to speak with them, Customs and Border Patrol agents at JFK said that they were not the ones to field such a request.

“Who is the person to talk to?” the attorneys asked, according to the complaint. The CBP agents responded: “Mr. President. Call Mr. Trump.”

I was just coming over to post something on this.

And goddamnit, those horrible lying lawyers are at it again, already filing actions to release these men and challenge the EO. They've been there trying to get to see their clients all night; the legal community is organizing to get them relief, and back up help. There is also going to be a big fucking protest at JFK this afternoon.

We have only just begun to fight.

y er gonna need more lawyers....

and as soon as you waste a lot of time and money on this "catastrophe' an exception will be made for these two , on a case by case basis, and you ll have wasted all that time and effort....

time is money....

by the end of next week you ll have twenty other shiney objects to chase around....

Gee wes, I had no idea that you were an expert on the statutory and Constitutional requirements regarding the entry of foreigners into the US...

We're very lucky to have you on the board...

Could you please explain your legal reasoning as to why the lawyers fighting this EO can't possibly win, citing the relevant wording from the statutes, Constitution, and case law that show Trump's EO to be an unassailablely lawful order. Please be specific.

apparently you didn t read my post carefully.

I said that this case would be rendered pointless as the case of the detained men would be handled properly....,in due time

my point about sticking to cases that had merit was a general one.

obstruction for the sake of obstruction is a political tactic, not a proper LEGAL tactic....

Trump’s Immigration Ban Blocks Travelers at Airports Around Globe

WASHINGTON — President Trump’s executive order on immigration quickly reverberated through the United States and across the globe on Saturday, slamming the border shut for an Iranian scientist headed to a lab in Boston, an Iraqi who had worked as an interpreter for the United States Army, and a Syrian refugee family headed to a new life in Ohio, among countless others.

Around the nation, security officers at major international gateways had new rules to follow. Humanitarian organizations scrambled to cancel long-planned programs, delivering the bad news to families who were about to travel. Refugees who were airborne on flights when the order was signed were detained at airports.

At least one case quickly prompted a legal challenge as lawyers representing two Iraqi refugees held at Kennedy International Airport in New York filed a motion early Saturday seeking to have their clients released. They also filed a motion for class certification, in an effort to represent all refugees and other immigrants who they said were being unlawfully detained at ports of entry.

Mr. Trump’s order, enacted with the stroke of a pen on Friday afternoon, suspended entry of all refugees to the United States for 120 days, barred Syrian refugees indefinitely, and blocked entry into the United States for 90 days for citizens of seven predominantly Muslim countries: Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen.

The White House said the restrictions would protect “the United States from foreign nationals entering from countries compromised by terrorism” and ensure “a more rigorous vetting process.” But critics condemned Mr. Trump over the immediate collateral damage imposed on people who, by all accounts, had no sinister intentions in trying to come to the United States.

An official message to all American diplomatic posts around the world provided instructions about how to treat people from the countries affected: “Effective immediately, halt interviewing and cease issuance and printing” of visas to the United States.

Confusion turned to panic at airports around the world, as travelers found themselves unable to board flights bound for the United States. In Dubai and Istanbul, airport and immigration officials turned passengers away at boarding gates and, in at least one case, ejected a family from a flight they had boarded.

Seyed Soheil Saeedi Saravi, a leading young scientist in Iran, had been scheduled to travel in the coming days to Boston, where he had been awarded a fellowship to study cardiovascular medicine at Harvard, according to Thomas Michel, the professor who was to supervise the research fellowship.

But Professor Michel said the visas for the student and his wife had been indefinitely suspended.

“This outstanding young scientist has enormous potential to make contributions that will improve our understanding of heart disease, and he has already been thoroughly vetted,” Professor Michel wrote to The New York Times. “This country and this city have a long history of providing research training to the best young scientists in the world, many of whom have stayed in the U.S.A. and made tremendous contributions in biomedicine and other disciplines.”

A spokesman for the Association of Public and Land-grant Universities — the association of large public colleges — said that the group was aware of an Iranian undergraduate student who had been barred from boarding a flight.

A Syrian family of six who have been living in a Turkish refugee camp since fleeing their home in 2014 had been scheduled to arrive in Cleveland on Tuesday, according to a report in The Cleveland Plain Dealer. Instead, the family’s trip has been called off.

Danielle Drake, a community relations manager at US Together, a refugee resettlement agency, told the newspaper that Mr. Trump’s ban reminded her of when the United States turned away Jewish refugees during World War II. “All those times that people said, ‘Never again,’ well, we’re doing it again,” she said.

On Twitter, Daniel W. Drezner, a professor at the Fletcher School of Law and Diplomacy, posted an angry message for Mr. Trump after the executive order stopped the arrival of a Syrian family his synagogue had sponsored.

It was unclear how many refugees and other immigrants were being held nationwide in relation to the executive order.

It has been almost one full year since the death of Supreme Court Justice Antonin Scalia on February 12, 2016.  It has been over ten full months (328 days, to be precise, since ) since then-President Obama nominated Merrick Garland on March 15th as Scalia's replacement.  However, on February 23rd — before a suitable candidate had even been named — the 11 Republican members of the Senate Judiciary Committee had sent a letter to Senate majority leader Mitch McConnell stating their intention to withhold consent on any nominee made by President Obama, and that no hearings would occur until after January 20, 2017; a childish temper tantrum that then proceeded to play out until the end of the 114th Congress.

Guin. Thank you. This sounds so snarky, but it is real. You have made me proud to be an American. I carry a burden of shame in my own heart over what I did not do when the streets where I had walked in Sarajevo were turned into a shooting gallery. The burden includes what I did not do during the mass killing by match and machete in Rwanda.

This is a Boston Tea Party I can join. The president did say in his Inaugural address, he was returning power to the people. Just as he seemed to have no feeling for the history of 'America First' so also he seems to have no feeling for the historical context of 'power to the people.' On 9/11 I left work and went to a local flag store and purchased a yellow Gadsden Flag. When it was taken to be the symbol of the ultra-right Tea-Party movement, I stopped flying that yellow flag. Monday I shall seek out the black flag with raised fist.

There Have Been No Fatal Terror Attacks In The U.S. By Immigrants From The 7 Banned Muslim Countries

There have been zero fatal terror attacks on U.S. soil since 1975 by immigrants from the seven Muslim-majority countries President Donald Trump targeted with immigration bans on Friday, further highlighting the needlessness and cruelty of the president’s executive order.

Between 1975 and 2015, foreign nationals from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen killed exactly zero Americans on U.S. soil, according to an analysis of terror attacks by the Cato Institute.

Moreover, a report released this week shows that Muslim Americans with family backgrounds in those seven countries have killed no Americans over the last 15 years.
