The Justice Dept. lawyers appear to be setting up a fall back position in the filing for their appeal, (due to be heard by a three judge panel from the 9th circuit, today at 3PM PT) :

SKBN15L0GCIn a brief filed on Monday, the Justice Department said the suspension of Trump's order was too broad and "at most" should be limited to people who were already granted entry to the country and were temporarily abroad, or to those who want to leave and return to the United States.

UNANIMOUS DECISION - feds request to lift stay DENIED!! WA State prevails. States retain standing to and reviewability of Executive action on immigration by courts, even under guise of "national security" is "beyond question."
A key conclusion: "In short, although courts owe considerable deference to the President’s policy determinations with respect to immigration and national security, it is beyond question that the federal judiciary retains the authority to adjudicate constitutional challenges to executive action."
The court also declined to limit the geographical scope of the TRO, or to limit it to only lawful permanent residents.

I actually listened to the telephone hearing with the panel from the 9th circuit.
the lawyer for the justice dept seemed ill prepared for the hearing.
he didn t really make any case or assert any evidence of the threats which the order was supposed to ease.
even I wasn t impressed by his arguments.
they were there to be made, but he seemed ill prepared

I'm really glad the decision was unanimous...
I haven't read the decision word-for-word, but in scrolling through and reading what I take to be the most important parts, it looks like a complete and total smack-down of the government's position...
Particularly the central claim that this EO was for some reason exempt from judicial review; the decision really tears that claim to shreds with numerous citations...
It looks like the Administration made a big mistake in trying to hang it's case on this, rather than providing any evidence for a national security justification for the order. (But I guess they really can't be blamed for that, since there isn't any.)

I think non-reviewability was actually the government's best argument tactically, because if it could have prevailed on that threshold question the court would then be precluded from addressing its complete loser arguments under the due process and religious discrimination tests. It's not a bad argument because it does implicate fundamental issues of separation of powers and the scope of constitutional protections. Although I think you are right to characterize the decision as "a complete and total smack-down of the government's position," it's not like they didn't have something to talk about. From a technical standpoint, I thought the jurisdiction and standing issues were interesting; but then I am a law-geek nerd.
