Weren't they like that at the turn of the century anyway? Some rule change in 2003 comes to mind (although I was probably drunk so I forgive me if I am remembering incorrectly)

oldr--my recollection of the filibuster is that it was around since the beginning of the senate, but rules for cloture (cutting off debate) did not appear until the early 20th century (originally 66 or 67 votes, then 60). As I recall, however, fillibusters could be regulated by refusing to grant any courtesy to those continuing the debate, making them continue for hours without any break, and then ruling that the senator yielded the floor if (s)he stopped speaking to use the restrooms or eat or whatever).
I'm not sure when the nuclear option rule became official, but now all judicial nominees can be voted on, and debate closed, by a simple majority vote.

No Marshal was not a tyrant, but there is big difference between interpreting where there is room to interpret and changing the meaning. I listened to the vote this morning on CSPAN radio en route to a physician appointment and I will admit I got choked up and tearful. Could be crazy menopause hormones, but I felt like it was the final death knell of the Congress I grew up fascinated by and passionate about. I went to law school in D.C. in '97 with the expectation of eventually becoming a legislative staff attorney, but became profoundly jaded by the actions of the Gingrich revolution's highly partisan Republicunts which I (along with far more learned pundits) mark as the beginning of the profound dysfunction in Congress. It seemed like the Senate was the last hope for civility and a cure for all that, but this really felt like a last nail in the coffin. Given what has been taking place at the state level, with ALEC infiltration of our legislatures and gerrymandering, I am losing hope for a brighter future for regular people.

For me, it is far better to grasp the Universe as it really is than to persist in delusion, however satisfying and reassuring.

What I'm more concerned with is as the legislative dysfunction increases, it makes it much more likely for some glib talking idiot to come in and take over everything because congress is merely ineffective. And de,mocracy will die not with shots and screams, but thunderous idiotic applause.

Gorsuch confirmed. And even though I am one of those who thought that he was perhaps the best we could hope for from this so-called 'president' I am appalled by the process. And I do not think that those accusations of plagiarism we minor. In a scientific context (don't know about legal) if you are quoting a secondary author who is quoting a primary, you always cite them both. The NYT gets this spectacularly wrong:
