But this is a terrible emergency. The sky is falling and POTUS will hold it up for us while his minions design a beautiful new way to stop the sky from falling. You will love it. The nasty DEM appointed judges (some of them are probably nasty immigrants, maybe even Mexican) won't let POTUS do it. So the POTUS has not even selected minions to do the job. It is such an emergency that the POTUS just had to forget about the whole thing while he mounted solar panels on his beautiful wall. ICE doesn't have time for this. They are much too busy deporting all the bad, bad people with unpaid parking tickets.

MOOT? Such fake news. Have you seen all my pictures on the covers of Time magazine?

About 150 days have passed since President Trump signed the first executive order, more time than the government said was needed to implement the necessary upgrades to immigration security. Assuming that the administration was reasonably diligent, shouldn’t the changes have been made by now, rendering the ban unnecessary?
The trial court in Hawaii even denied the ability of the administration to study and work on improving vetting procedures in the high-risk countries (part of the order later reversed in the Ninth Circuit).

Oh come on--I'm sure Trump would say this could have been done by now if they didn't have to divert their effort from beefing up the standards to fighting in court--the man is nothing if not shameless.

The judge in the Hawaii case provided a valid excuse for why the administration hasn't completed the review and revision of screening procedures, so blame that judge for both over-reaching and giving Trump an out for the delay in getting the review done. Of course, the review (and excuse for the delay) should be long past by the time the Supreme Court reviews this on the merits, making the case moot. If the Trump team has any sense, it will in fact get the review done so they can claim victory with the unanimous SCOTUS decision, and look like they improved the screening process. That is a pretty big "if" though.

Yes, not exactly an overwhelming amount of evidence to date to suggest that will be the case...

How long was it before the 9th Circuit overturned that part of the ruling, about four days?

Actually, the Hawaii decision was March 15 and the 9th Circuit opinion was June 12. So the timing is: initial travel ban, January 27; overturned by various courts the first week of February; revised travel ban issued March 6; overturned by court in Hawaii on March 15, which included prohibition on working on the screening revisions; 9th Circuit reverses lower court ruling on June 12 with respect to working on screening revisions; SCOTUS reverses 9th (and 4th) circuit preliminary rulings and allows travel ban on June 26.

The initial request was for 120 days to review the screening procedures ("The executive order suspends the entry of refugees into the United States for 120 days and directs officials to determine additional screening"). If they got to work right away on January 27 despite the court proceedings, they had 47 days until March 15. The work presumably stopped until June 12 pursuant to the Hawaii district court ruling , so as of today 63 days have passed.

So by October there should be no need for the SC decision--but I doubt we will ever see the revised screening rules.

The whole thing is ridiculous...

It's always been about throwing red meat to his Trumpanzee Faithful, and has never had anything to do with US security...

On Jan. 27th, when he issued the first EO, he claimed, (this is not an exact quote, but he said words to this effect)

"I thought maybe we could wait a month before issuing this order, but I was told that because of the threat, I had to order it right away"...

So, the supposed "point" behind this EO, was that there was such a clear and present danger from terrorists pouring over the borders from the targeted countries, that there was not one minute to waste to stop this invasion of terrorists...

(Of course since then, while there may have been terrorist plots thwarted that were planned by these hypothetical ne'er do wells, there is certainly no evidence that any have been successfully carried out; if a terrorist attack was carried out by a group of Syrian refugees, the fake news must have failed to report it...)

This whole waste of the taxpayers money has never been about "keeping America safe"...

It's always been about "keeping my Trumpanzees happy"...

Oh those pesky lawyers (especially the ones that become federal court judges)!

Texas anti-sanctuary city law blocked while suit proceeds

AZ judge requires hearing before she vacates Arpaio conviction

And the ACLU is gearing up to file case challenjng the military transgender ban and perhaps even the Arpaio pardon itself.

I'm reminded of that oft misused Shakespeare quote from Dick the Butcher in Henry VI, Part II:

"The first thing we do, let's kill all the lawyers."

Shakespeare knew that the lawyers are the bulwark between justice and tyranny.

And in another excellent strategic move, Mueller teams up with the NYAG on Manafort investigations

Because one thing we do know about the limits on Presidential pardon power - it does not apply to state crimes.
