Judge orders plane carrying deported mother and daughter to turn around

An angry federal judge ordered a plane carrying a mother and her daughter to turn around and head back to the United States, hours after being whisked away by U.S. authorities before a court hearing on their deportation status could be finished.

"I know I'm raising my voice, but I'm extremely upset about this," U.S. District Court Judge Emmet Sullivan said during Thursday's hearing. "Somebody … seeking justice in a United States court is spirited away while her attorneys are arguing for justice for her? It’s outrageous. Turn that plane around and bring those people back to the United States."

A Department of Homeland Security official said the agency has complied with the court’s order. By Thursday evening, the mother and her daughter had landed in El Salvador. But they did not disembark, and the plane immediately headed back to Texas, the DHS official said.

Had the family not been returned, Sullivan was prepared to order Attorney General Jeff Sessions, Department of Homeland Security Secretary Kirstjen Nielsen and other senior administration officials to appear in court "to show cause why they should not be held in contempt of court."

The greatest minds which POTUS has assembled to make his tweets reality give me a headache. Can they do thought experiments that go beyond the next 30 seconds? Groups of people are stopped at the border by ICE (which now spends more money than all the other federal law enforcement groups combined) the children are separated from the adults they are traveling with. Some of the adults are removed from the USA immediately. Just what did ICE think was gonna happened to the minors with those adults now out of the country?

ICE now has responsibility for those children. An entire new federal welfare infrastructure and everything that goes with it now is required. Certainly the local child protective services has no connection with these kids. It is ICE that took the kids away from the adults.
Do they now understand ICE has created an entire new group of 'Dreamers'-- undocumented child-residents of the USA that must be humanely nurtured?

No one at ICE came up with this policy....

This was the brilliant idea of Donald Trump and Jeff Sessions, and it was implemented as a result of Trump's pique about an uptick in illegal border crossings, (after a steady multi-year decline) and his outrage at the publicity the bus caravan from Central America was getting, ("How dare these refugees from shit hole countries think the could come to the US on my watch!")

"Thinking" didn't enter in to it...

They had no policy for what to do with the kids or how to reunite them with their parents because they didn't give a shit about either; those considerations weren't even on their radar screen. All they were looking for was a show of how "tough" they were, and to try to deter more people from coming by showing them the level of inhumane cruelty that would meet them if they did.

Increasing human misery (for both the parents and the kids) wasn't a byproduct of this policy; it was the policy goal...

I think that's often the policy of ICE as well; I had a daughter of one of my clients who came to the US from Honduras seeking asylum. She was placed into custody and I arranged representation, but in over 4 weeks she was moved from Houston, to Chicago, to Louisiana, even placed on a plane and threatened to be brought back home. Each time she was moved I had to arrange for alternate counsel in the area (and it often took a 4-6 days to find out where she was), but she ultimately got her entry approved pending a hearing on the merit of her case. She is 19 and now resides with her mother in NJ.

ICE didn't have to do it this way, but it's what they do--and Obama was president then, not Trump. they wanted to make her miserable enough to voluntarily leave, as well as to mess with her access to counsel..
