In the mind of a proud Puerto Rican how is burning a Puerto Rican flag any different than burning cross?
I expected to be placed in an air force combat position such as security police, forward air control, pararescue or E.O.D. I would have liked dog handler. I had heard about the dog Nemo and was highly impressed. “SFB” is sad I didn’t end up in E.O.D.

Puncher didn’t intend for white drunk guy to die - at best it’s involuntary manslaughter and since the DA isn’t charging that, and the office isn’t known for undercharging, they clearly have reason to believe such charge is unsupported by evidence and unlikely to be proven at trial.

I’ve seek one punch cases prosecuted, unsuccessfully. Juries are reluctant to blame defendants for the injuries caused by pavement, even when contact with pavement came as a result of one punch. Juries often sympathize with the puncher, especially when the punchee was seriously inebriated and obnoxiously combative in his behavior.

Imagine how all this tragedy might have been avoided if the victim’s family had taken better care of him when he was clearly very overly intoxicated and shouldn’t have been stumbling around alone for an Uber or anything else.

Puncher’s life has been pretty well destroyed too, it appears - lost his job at Wake Forest and no other employment currently reported.
He went out of his way to kill the white boy who was walking away. What would happen in a liberal state if a home owner killed an intruder that was walking away?

Well I have to say, that's exactly what the video clearly indicates...

Jones gets out of his car, and takes off after Szabo at a dead run, (running at least what looks to be 30 or 40 feet to catch him) catches up to him, and with no menacing behavior on Szabo's part whatsoever, puts him out flat with one punch and then walks away...

There's no possibility for self-defense, or fear for safety to be invoked here...He chased a man down who represented no immediate threat to him, and physically attacked him, knocking him unconscious and then walking away...

That's pretty clear cut...

I suspect that Szabo must have made some sort of verbal taunt that set James off, but that is absolutely no excuse for what he subsequently did...

Yeah well, the office may not be "known" for undercharging, but DA's (who are afterall, politicians) have been known to both undercharge and overcharge for political reasons particularly in locally sensitive high-profile cases; it does happen...

I have to agree with lib at least in part here; that video certainly makes James' actions look a lot worse than that excuse-making opinion piece makes him look. Based on that fairly clear-cut video, James' actions look completely indefensible to me. In fact, given his cavalier behavior after knocking the guy out, the phrase "depraved indifference" comes to mind...

Seems to me the evidence indicates there was more than one asshole out on that street that night...

Pardon me LJ, but I didn’t make excuses for the puncher. I simply provided legal analysis based on my actual experience with similar cases, resulting in permanent disability and in one case, death. In the cases I saw the prosecutor overreached with charges and acquittal was the result. As I said, juries in my experience are not very sympathetic to voluntary intoxication - this same dynamic plays out in their unwillingness to consider drunk rape victims as equal to sober rape victims - and are reluctant to blame the one punch rather than the concrete/asphalt that is actually the proximate cause of brain injury resulting in death.

I posited some possibilities for what took place to provoke the puncher, and I shared information left out of liberty's account regarding the puncher’s claim that punchee shattered his rear car window - but I did not excuse his assault on the guy. That’s a conclusion you came to without, I would argue, sufficient evidence.

TO BE CRYSTAL CLEAR: I DON’T ADVOCATE OR EXCUSE DISPLAYS OF ELEVATED TESTOSTERONE IN THE FORM OF PUNCHING PEOPLE, EVER. Why not? Because I have actually seen real people in real life who I really knew be killed and/or permanently debilitated by the effects of one punch that resulted in subsequent contact with concrete/asphalt and serious brain damage. I think boxing is barbaric - I think fucking football is barbaric, for that matter.

But a punch resulting in a fall that results in brain injury is not murder, as liberty would have it.

Someone certainly seems obsessed with the idea of burning the Puerto Rican flag, repeatedly bringing it up in the context of an incident where it never happened. Wishful thinking?
