Colorado restaurant shut down for opening in-person dining

DENVER (AP) — A restaurant that opened for full service on Mother’s Day in defiance of state rules banning in-person dining was ordered closed by state health officials on Monday.

A video posted by Colorado Community Media showed people sitting at tables and waiting close together in line at the counter while others lined up outside for a chance to get inside the eatery in Castle Rock about 30 miles (48 kilometers) south of Denver.

Except for one person wearing a mask, the scene and the din of people talking appeared like just another busy day at any restaurant before the government limited eateries to all but take out service to stop the spread of the coronavirus.

The Tri-County Health Department said C&C Coffee and Korean Kitchen was ordered to remain closed until the department determines that is in compliance with Democratic Gov. Jared Polis' latest health public health order. If the owners refuse to comply, further legal action would be taken against the restaurant that could include the revocation of its license, the department said.


“It is disheartening that this restaurant has chosen to move ahead of the public orders and not even consider implementing best practices to prevent the spread of COVID-19. It is not fair to the rest of the community and other business owners that are following Safer at Home and doing their part," the department's executive director, John M. Douglas, Jr. said in a statement.

In a tweet to President Donald Trump, the restaurant's owners said they were standing up for America, small businesses, the Constitution and against Polis' overreach in response to the outbreak.



The owners, Jesse and April Arellano, could not be reached for comment by telephone on Monday. After laying off most of their staff during the outbreak, Jesse Arellano told KCNC-TV on Sunday that they wanted to stand up for small businesses and get the attention of lawmakers. He acknowledged they could face sanctions for their actions but said they wanted to know much support they had.

“We figured if we're going to crash, we're going to go down and see how many people stand with us,” Jesse Arellano told the station.

While restaurants in Colorado are not allowed to offer sit-down service under Polis' latest order, the state has allowed restaurants in western Colorado's Mesa County to open tables to customers — though only at 30% capacity — because of its low number of cases.

Mesa County has not had any coronavirus deaths. Douglas County, a wealthy county that is a mix of suburban and rural areas, has had 28 deaths due to the virus, about 3% of the statewide count.

For most people, the coronavirus causes mild or moderate symptoms, such as fever and cough that clear up in two to three weeks. For some, especially older adults and people with existing health problems, it can cause more severe illness, including pneumonia and death. The vast majority of people recover.

Texas man fired from law firm after threatening to shoot up Whole Foods that requires face masks

A Texas man lost his job at a law firm after he threatened to shoot up a Whole Foods for trying to protect workers and shoppers during the pandemic.

“No more masks,” administrative assistant Kevin Bain posted on Facebook Friday, according to Courthouse News Service.

Bain had reportedly worked for the Dallas firm Thompson & Knight for over a decade before figuratively shooting himself in the foot.

“Any business that tells me to put on a mask (Whole Foods on Lomo Alto) in Dallas will get told to kiss my Corona ass and will lose my business forever,” Bain allegedly wrote on a Facebook page that was not available Monday. “It’s time to stop this BULLS--T. Do I have to show the lame security guard outside of a ghetto store my CV19 test result?”

Bain boasted that he’d instead show essential workers what he could do with a Glock 21 handgun loaded with hollow-point bullets.

"Pricey ammo, but worth it in this situation” Bain allegedly wrote. “They have reached the limit. I have more power than they do … they just don’t know it yet.

In his menacing missive, the former law firm employee and a Facebook friend named Patrick Bain agreed that teenage essential workers who try and do their jobs should be shot.

“The teenager at Kroger says you can’t come in without a mask on. You are legal. What happens next if they don’t give you a useless mask?” the first Bain asked.

“Well if you (sic) carrying you just shoot him,” Patrick replied.

Excerpts from Bain’s online tantrum were posted by Dallas SI United, which represent service industry employees. That organization reported Thompson & Knight had canned Bain and wrote that Patrick should be held accountable for his menacing reply.

Thompson & Knight wrote on Facebook Friday that the law firm had seen Bain’s posts and terminated his employment.

“We have terminated this individual’s employment and notified the proper authorities about the post as a precaution,” the firm wrote. "We are deeply sorry for this situation. This type of post is not and never will be tolerated by our Firm.”

The Bains are among a number of Americans who believe it’s their right to be served by store workers, even when choosing to flout CDC rules meant to keep workers and shoppers safe.

A “Boycott Cosco” movement began last week when that retailer began enforcing face mask rules for shoppers.

"Dictating face mask for your workers is one thing but forcing this on your loyal members who paid for a membership is a complete abuse of power,” one angry consumer whined on Twitter.

Several users responded that shoppers who don’t like Costco’s practices are free to take their business elsewhere.
Isn't this exactly what the pro-death faction wants, for businesses to re-open on their own terms, and for those customers who choose to accept the conditions to frequent them, while those who don't can stay home? Funny how when the shoe is on the other foot that their first impulse is to threaten to assassinate those following the protocol that they themselves have been fighting for.
