Massachusetts strikes another blow for marriage equality!

The First Circuit just found that section 3 of the Defense of Marriage Act ("DOMA"), 1 U.S.C. § 7, which denies federal economic and other benefits to same-sex couples lawfully married in Massachusetts and to surviving spouses from couples thus married, is unconstitutional, upholding the lower court's finding. The injunction prohibiting the government from enforcing section 3 of DOMA remains stayed while an application for certiorari is filed.

I've only briefly scanned it, but the opinion was written by the former Chief Judge of the First Circuit Boudin, who is a two-time Bush appointee.

History marches on. There is a sense of inevitable victory for the forces of right and justice here. Polls of younger people indicate clearly that homophobia will die out soon.
